Coroner confirms slow agony of elderly man killed in deadly Ibiza fire, says defendant was conscious

The jury trial being held at the Provincial Court of Palma for the deadly fire that occurred in ses Païsses (Ibiza) in August 2023 has revealed this Friday new details about the death of the 77-year-old man who lost his life in the incident, allegedly provoked by his son’s partner. The forensic doctor in charge of the autopsy has stated that the victim suffered a “slow agony” from smoke inhalation, unable to flee due to his physical dependence.

During his appearance, the doctor explained that the body of the deceased had second-degree burns only on the front and side of the body, indicating that the fire did not burn him completely. The determining cause of death was the massive inhalation of smoke inside the house, from which the elderly man could not escape due to his reduced mobility.

The coroner also prepared a psychiatric report this year on the accused, then partner of the victim’s son. In this document he concludes that, although she suffers from schizoaffective disorder, at the time of the events she did not suffer any outbreak or alteration that affected her ability to understand or decide, so she was “fully aware” of her actions. According to his statement, in the interview he detected in the defendant coldness, lack of empathy and indifference, as well as “nebulous” only in those memories related to the investigated facts.

A jury trial for murder and arson

The Jury Court has been trying the defendant since Monday for one count of murder and one count of arson, since two elderly people she cared for were sleeping in the house. One of them – the elderly dependent – died, while the other managed to survive. The Prosecutor’s Office requests for her the penalty of permanent revisable imprisonment.

The Public Prosecutor’s Office maintains that the deceased victim was totally dependent and had no possibility of leaving the property when the flames began to spread. The prosecution maintains that the fire was intentionally set by the woman, whose criminal responsibility will be assessed by the popular jury in the coming days, before the court passes sentence.
