The press conference of Llorenç Cordoba last Monday has left splinters in all the political groups of Formentera, which draws a situation of widespread corruption involving the PP, Compromís, PSOE y Gent per Formentera. One of the points addressed by the President of the Consell Insular has been the incompatibility of Javier Serraas La Voz de Ibiza had advanced last July. It is that the president of Compromís also had a 22.40% stake in the company Marina de Formentera of which he would have allegedly divested after the revelation of this medium. This has generated a situation of incompatibility during the year in which he served as vice president, so the Consell has put into action the review and possible nullity of the acts, votes and contracts in which Serra has had participation. For that, Cordoba explained to have requested a report to the secretary of the Consell de Formentera, Angel Custodio Navarro, to thoroughly analyze all decisions in which Serra has participated.
Córdoba added that this request, for the moment, has been ignored by the secretary. “I asked for an urgent report to the secretary and I still have not been answered,” Cordoba said this week. During the press conference, the insular president said that this documentation is within the three presentations to the Anti-Corruption Prosecutor’s Office that would be investigating the UCO of the Civil Guard in the preliminary inquiries necessary to determine whether there are sufficient grounds to file complaints against those involved. “The complaint against the minister Serra was filed later because I was not aware until June that this situation remained so at the beginning of the legislature. All the councilors knew that he had this incompatibility, but he told us that he had solved it and I did not talk about it again until he himself confirmed it and declared it. Its dual function
Javier Serra has declared both publicly and legally his participation in Marina de Formentera SA. However, Law 53/1984, on Incompatibilities of Personnel in the Service of Public Administrations, establishes a limit of 10% for participation in companies that contract with the public administration. Marina de Formentera S.A. has -since 2010- the authorization for the exploitation of premises and offices in Building B of the port of La Savina. The concession covers premises of 207.55 m² on the ground floor and 492.82 m² on the upper floor, destined for offices for companies linked to maritime traffic, with a duration of the concession of 14 years and a base budget of 24,262 euros and annual fees totaling 43,000 euros.
The nature of the standard
This 10% restriction on participation in companies that hold contracts with the public administration is aimed at prevent conflicts of interest and ensure impartiality and transparency in public management.
In the case of Javier Serra, his participation in Marina de Formentera not only exceeds the permitted limit, but also raises doubts about the influence he could have had in the decisions and contracts awarded to this company or others that are of an indirect interest. Córdoba has pointed out on several occasions that the opposition has failed to address this issue, allowing the situation to persist without the necessary corrective actions.
