Nestled on the coast of Es Cubells, south of Ibiza, the Vista Alegre urbanization has been synonymous with luxury and exclusivity for decades. The Sant Josep Town Hall has denied up to 31 building licenses in the last year and a half, arguing that the plots do not meet the minimum conditions to be considered plots. These deficiencies stem from the absence of essential infrastructure, such as paved streets, sidewalks and basic facilities, as well as the lack of execution of key elements of the original project approved in 1993.
The reasons behind the legal blockade
The Urban Planning Law of the Balearic Islands (LUIB) establishes that only plots of land that meet the requirements as building plots can be built on. This implies that they must have public access, basic services such as drinking water and electricity, and conform to the alignments established in the urban planning project. In the case of Vista Alegre, these conditions have not been met: the layout of some streets does not correspond to the approved one, sidewalks are missing and some roads have not even been built. In addition, the original project contemplated key infrastructures, such as a desalination plant and water treatment plants, which have not yet been executed. Although the law allows, in exceptional cases, construction licenses to be granted in parallel with the execution of urbanization works, the long delay -more than 25 years since the project was approved- and the poor quality of the works have led the City Council to block new concessions. A technical report from the Consistory also points out that the works executed are not only incomplete, but also fail to comply with legal standards. These irregularities have led to a series of legal appeals filed by the affected owners, who consider that the City Council is acting arbitrarily and are asking for a proper justification for the change of criteria in the granting of licenses. In this sense, Vicent Roig, mayor and head of Urbanism, explained to Diario de Ibiza that ”
not all the roads foreseen in the urbanization project have been built, some can no longer be executed and not all of them are correct. Under these conditions, no more licenses can be issued. There comes a point when the Administration must act”.
