The fact is that the works carried out in the property of 167 square meters are illegal and will end up being demolished if the regulations are complied with. Much of the work carried out in the house could have been subject to a building permit and, therefore, be legal in an urban land that was not affected by the regulations of the natural park. However, the couple’s actions have a simple and pragmatic explanation: the Duatos would not have been able to obtain such a license because such permits cannot be granted on urban land within the natural park until the new General Urban Development Plan (PGOU) of the municipality of Sant Josep is approved. This is established in article 27 of the Master Plan for Use and Management (PRUG), which determines the guidelines for urban land management within the natural park. It stipulates that “no license may be granted for any new construction, expansion or modification of existing buildings on urban land” until the “adaptation of urban planning instruments” has been completed.
Out of order
For its part, Article 58 of the Natural Resources Management Plan of the Natural Park of Ses Salines de Ibiza and Formentera (PORN) differentiates between traditional buildings and those that are not. The former are those “of architectural or landscape interest that correspond to an appropriate structure of occupation of the agricultural territory that should be maintained, preserved, restored or improved”. This is not the case of Duato’s new house.
Point 7 of the same regulation establishes that those “legally constructed buildings that are not included in the catalog foreseen in this article, will be considered non-conforming for the purposes of the provisions of article 3 of Law 8/1988, of June 1, of buildings and facilities out of management. The Master Plan for Use and Management will establish the minimum conditions for intervention in these buildings that the municipal planning must establish in accordance with the provisions of the aforementioned article 3 of Law 8/1988″. Within this spectrum is the Duato estate, i.e., out of management. Therefore, only basic and minimal maintenance tasks are allowed. The new regime of out-of-order situations in the Balearic Islands establishes that, “in any case and as a minimum, the works of health, safety, hygiene, repairs and consolidationsare authorized as long as they do not affect the part of the building or construction carried out illegally“. In order to undertake any other type of work, the couple would have had to request -which did not exist- a report from the natural park, which would have been clearly unfavorable.
The house in question
As La Voz de Ibiza has advanced, the couple has bought the property located in Section 1, Polygon 3 and Number 4914, which was for sale for 1.2 million euros, although the amount for which the operation has finally been finalized is unknown. It is a plot of land with a house located within the natural park. It has 167 square meters built on a plot of 742 square meters. 100% of the property has passed into the name of Shuagathan 2018 SL, a company incorporated in July 2008 and which replaced the fantasy name Ganga Proyectos SL. The latter was the family production company created in 1997 by Miguel Ángel Bernardeau.
The shares of the company were divided between 40% of the actress, another 40% of Bernardeau and the other 20% of the son in common, who has the same name as his father and who became known for his performance in Élite and for being the partner of the singer Aitana.
Minor and major works
These irregularities have triggered an unsuccessful inspection of the Local Police of Sant Josep in the absence of the dwellers.
