The company Marina de Formentera, which has occupied during the summer season 2022 the western dock of the port of port of La Savina illegally, since it did not have the corresponding enabling title after losing the concession, is now facing a legal process. As confirmed by the Port Authority of the Balearic Islands (APB) to La Voz de Ibiza, at the meeting of the Board of Directors on April 18, 2024 “it was agreed to transfer to the Public Prosecutor’s Office the possible commission of several crimes by Marina de Formentera as a result of its refusal to return the port public domain that it illegally occupied”. In the resolution of the Board of Directors of the APB, to which La Voz de Ibiza had access, it is recorded that it has been unanimously agreed the “proposal of communication to the Public Prosecutor of the actions related to the refusal of MDF (Marina de Formentera) to deliver the facilities of the administrative concession for the Management of mooring places in the inner west dock of the port of La Savina“. Therefore, the Public Prosecutor’s Office has been informed “of the facts referred to in the proposal, giving transfer to the State Attorney for their appearance and the instructor of the sanctioning procedure”.
Squatters
A day before the end of the concession, on May 27, 2022, Marina de Formentera announced that it would not abandon the port facilities in the western dock pending the resolution of the contentious appeal it had filed after the APB denied it a 35-year extension. In a press conference, the company’s representative, Ángel Bustosaccompanied by the lawyer Francisco Javier Jiménez Cisnero Francisco Javier Jiménez Cisneros de Cid announced this decision and accused the APB of acting in a “discriminatory” manner by not granting an extension.
Bustos questioned the APB of conducting a “public auction” that has not taken into account the economic and financial report of the bidders. For this reason, they had gone to the High Court of Justice of the Balearic Islands to reverse the decision of the APB of February 23, 2022 in which the extension of the concession was denied. With this, Marina de Formentera became a squatter for the entire summer season, the most profitable and obtaining a significant lucrative benefit, something that had never occurred in the history of the APB. For this reason, the president of the organization at the time, Francesc Antich, had to file an eviction laws uit with the Superior Court of Justice of the Balearic Islands (TSJB), since Marina Formentera did not have the necessary authorization to do so. This made it impossible for approximately four and a half months for Port Med Formentera, owned by the group of Nicolás Mayolto take possession of the concession for the management of berths and premises in the west inner dock, which it had won in a public tender for temporary occupation for a maximum of three years with an offer of 1.5 million euros, which tripled the starting fee of the tender. Only on October 4, 2022, Marina de Formentera announced that it was abandoning motu proprio in the face of the imminent forced eviction of the APB. At that time, the Board of Directors had already decided to reject the appeal for reconsideration filed by the lawyer Jiménez Cisneros.
