“A confession of parties, relay of evidence”. The awardees themselves of the new beach bars of Formentera, involved in the scandal over the mega tender under suspicion, have recognized a new irregularity: a key document that should have been made by the Consell Insular itself, was prepared by the interested parties themselves.
This is clear from the statements made by the spokesman for the concessionaires’ collective, Juanjo Costa, head of the beach kiosk of Migjorn, who was ‘authorized’ to bury pipes without a license under the protected dunes because his beach bar does not have road access, something established in the General Coastal Regulation to allow water supply and sewage disposal. In an interview on Ràdio Illa, Costa said that “we helped by providing a planimetry because if not maybe we would still be waiting”. According to the process, the chiringuitos must send the plans of the chiringuito to the Consell and it is the Consell that prepares the planimetry, which establishes the layout, shape and location of the beach kiosks. All this is then sent to the Conselleria del Mar y del Ciclo del Agua. The reasons for which the elaboration of this planimetry was not carried out by the Consell de Formentera, either with its own means or by outsourcing the work, are unknown.
Surprised
Several bidders have been surprised by these statements. Therefore, the former concessionaires have submitted to the Consell Insular a letter demanding a copy of the planimetry delivered, the author or authors of such planimetry and the invoice or responsible for the payment of the study. In this sense, they want the Consell Insular to clarify this issue because it is a “highly irregular fact“, as they have described it. In addition, they will request the stakeout reports because “we understand that this part planimetry contains errors regarding locations and orientations“.
The staking out minutes?
These inconsistencies and irregularities in the planimetry reports would be behind another illegality: the lack of staking out minutes.
During the 2024 season, the kiosks have been operating without the required complete staking out report, a technical document that certifies the correct location and construction of the infrastructures in the Maritime-Terrestrial Public Domain (DPMT), which consists of an initial report at the beginning of the assembly and a final one, as an evaluation of the facilities.
