The attempt of the Consell de Formentera to keep the beach kiosks operational during the period established for their dismantling has been rejected. As reported by the General Directorate of Coasts and Coasts of the Balearic Government, the precautionary measures presented by the insular institution have been rejected, reaffirming the obligation to dismantle the facilities between January 15 and February 15, as dictated by the administrative concession.
Position of the Balearic Government: compliance with regulations
The Government has insisted that it is essential to respect the conditions of the concession. In case of non-compliance, they warn that sanctioning proceedings could be initiated against the concessionaires. The autonomous administration has recalled that, although a few weeks ago it was mentioned the possibility of requesting modifications in the concession to make the dismantling more flexible, this option would not be applicable before 2026 due to the complexity of the procedures, as reported by Radio Formentera. The Consell de Formentera had requested precautionary measures to prevent the dismantling, a measure that has now been dismissed, leaving without effect its proposal to keep the facilities operational during the month stipulated for their dismantling.
Dealer reaction
For their part, the affected dealers have expressed their dissatisfaction, describing the dismantling as “impossible” on these dates. In addition, they have indicated that they are studying the possibility of filing an appeal for reconsideration against the resolution of the Balearic Government. It should be recalled that this process is part of a controversial context that includes questions about the transparency and legality of the public tender for the award of the kiosks, a matter that has been under scrutiny in recent months.
A conflict without immediate resolution
The situation poses a tense scenario between the different parties involved: concessionaires, Consell de Formentera and Govern Balear. While the concessionaires argue the logistical and economic difficulties involved in the dismantling, the Balearic Government maintains its firm stance on compliance with regulations.
