The Supreme Court has confirmed the sentence of 11 years and 11 months in prison imposed on a woman for offering her underage daughter for sex in exchange for money, as well as the 10-year prison sentence for the man who paid for the abuse.
According to the sentence of the Criminal Chamber, to which Europa Press has had access, the high court rejects the appeals filed by both convicted against the ruling of the High Court of Justice of Castilla-La Mancha, which had already appreciated the commission of crimes of sexual assault and corruption of minors.
In addition to the prison sentence, the TSJ imposed on the mother 10 years of probation and a ban on approaching or communicating with her daughter for 18 years.
Repeated payments in exchange for sexual abuse
The proven facts date back to 2020, when the defendant first had sexual relations with the minor, knowing that she was 13 years old, even giving the mother up to 6,000 euros. These practices were repeated on several occasions during the following two years.
The sentence states that the man made payments of 1,000, 200, 50 and 20 euros, both to the mother and the minor, in the context of this abuse.
Recordings, witnesses and signed receipts
The Supreme Court considered the mother’s guilt to be fully accredited, based on extrajudicial videotaped statements of the minor, which were ratified by persons present at the time they were made.
One of the witnesses testified at the trial that the minor told her the facts spontaneously after an argument with her mother, with a testimony that coincided with the content of the recording. Another neighbor stated that, after learning of the facts, she reproached the mother for her behavior and that she recognized that she was prostituting her daughter.
The magistrates also underline the existence of receipts signed by the mother and daughter, which documented the delivery of the minor to the co-defendant for sexual relations.
