The mayor of Sant Josep, Vicent Roig, has called an extraordinary plenary session for next Monday to move forward with the process to reverse the declaration of ruin of Block A of the Don Pepe building, after the independent technical report that establishes that its rehabilitation “is technically, economically and constructively viable”.
A report of the City Council gives the green light to the mayor to proceed to “carry out the appropriate judicial and/or administrative actions, in accordance with the applicable legal regulations, in order to attempt a judicial settlement in the judicial proceedings that are being followed against the agreements of Ruin and eviction of the Cantos Rodados apartments in the referred contentious-administrative area”.
This judicial settlement seeks to establish an agreement between the parties to put an end to the litigation, avoiding the judge’s ruling on the merits of the case.

The provisional proposal of judicial transaction must be taken to Plenary for final approval. It is that, as established by the secretary of the City Council, Maria Domingo Garcia, this reuiere the authorization of the Plenary.
“On the judicial transaction to some analogous legal figure in law, the procedures followed in the contentious-administrative courts, generally for agreements involving transactions or waivers in judicial proceedings of special relevance require the authorization or ratification of the Plenary. It is for this reason that the Mayor’s Office proposes that the present resolution be submitted to the Plenary”, it stipulates.
Failed attempt
In the December plenary session held this Thursday, the government team tried to deal with this proposal by means of urgency.
However, the opposition groups requested more time to study all the documents.
