After the auction, the former tenants exercised their <strong data-start=\"1060\" data-end=\"1097\">right of first refusal<\/strong>, presenting a <strong data-start=\"1114\" data-end=\"1155\">bank guarantee of 102,000 euros<\/strong> to match the successful bidder&#8217;s offer and cover expenses. <\/p>\n<p data-start=\"1219\" data-end=\"1495\">However, the handover of the apartment was delayed while the new owner and the tenants litigated over the validity of the withdrawal. During this time, the couple was forced to <strong data-start=\"1408\" data-end=\"1430\">rent another apartment<\/strong>, which was finally considered a <strong data-start=\"1473\" data-end=\"1494\">compensable damage<\/strong>. <\/p>\n<h3 data-start=\"1502\" data-end=\"1563\">The Supreme Court speaks of civil liability, not of possession<\/h3>\n<p data-start=\"1565\" data-end=\"1938\">In its ruling, the Supreme Court determines that the <strong data-start=\"1606\" data-end=\"1662\">resistance of the successful bidder to deliver the property<\/strong>, despite the existence of a final judgment and a valid guarantee, was an <strong data-start=\"1728\" data-end=\"1755\">unjustified action<\/strong>.
