The bullfighter, 48 years old, suffered last Sunday a mishap with his vehicle in <g id=\"gid_1\">the traffic circle of access to the Real Club Sevilla Golf<\/g>, located next to the urbanization in which he lives. The incident took place around <strong data-start=\"899\" data-end=\"919\">eight o&#8217;clock in the evening<\/strong>, when Cayetano was returning home after a quiet day. <\/p>\n<h2 data-start=\"998\" data-end=\"1045\">The accident, according to the lawyer&#8217;s account<\/h2>\n<p data-start=\"1047\" data-end=\"1120\">Moeckel has offered his version of what happened in statements to <em data-start=\"1112\" data-end=\"1117\">LOC<\/em>: <span style=\"font-size: 16px;\">&#8220;According to Cayetano, he was returning home shortly after eight o&#8217;clock in the evening. It&#8217;s not seven o&#8217;clock in the morning or anything like that, be very careful with that, the hours are very important&#8221;.<\/span><\/p>\n<p data-start=\"1334\" data-end=\"1713\">The bullfighter was driving along the road leading to his urbanization when, according to his defense, <strong data-start=\"1429\" data-end=\"1504\">he was distracted looking for the automatic control to open the garage fence<\/strong>. &#8220;At that moment, Cayetano started to look in the car for the automatic control to open the fence, and he got distracted. Despite the impact, <strong data-start=\"1807\" data-end=\"1845\">Cayetano got out of the car without help<\/strong> and remained for a few minutes next to the vehicle, with a jacket hanging from his arm, as shown in the images posted on social networks. <\/p>\n<h2 data-start=\"1992\" data-end=\"2050\">&#8220;There was no escape&#8221;: the version of his departure from the site<\/h2>\n<p data-start=\"2052\" data-end=\"2195\">The Sevillian lawyer insists that his client <strong data-start=\"2099\" data-end=\"2128\">did not try to flee the scene<\/strong>. &#8220;Obviously, that is not done by anyone who is going to flee,&#8221; he points out.   <span style=\"font-size: 16px;\">&#8220;He told them that, since he lives next door, and since thank God there was no personal injury to anyone, he was going to go home, and that if the police or anyone came, to tell them where he was. A person who wants to flee, doesn&#8217;t go to his house 25 meters away,&#8221; Moeckel adds.<\/span><\/p>\n<p data-start=\"2472\" data-end=\"2618\">It was the neighbors and witnesses themselves who <strong data-start=\"2518\" data-end=\"2548\">alerted the authorities<\/strong>, following the usual protocol in any traffic accident.<\/p>\n<h2 data-start=\"2625\" data-end=\"2666\">The controversy of the breathalyzer test<\/h2>\n<p data-start=\"2668\" data-end=\"2910\">One of the most commented points after the accident has been whether <strong data-start=\"2730\" data-end=\"2793\">Cayetano Rivera refused to take the breathalyzer test<\/strong>. He consciously did not refuse to take the breathalyzer test,&#8221; he adds.<\/span><\/p>\n<h2 data-start=\"3578\" data-end=\"3629\">&#8220;It could have been an oversight or a failure of reflexes.&#8221;<\/h2>\n<p data-start=\"3631\" data-end=\"3843\">Regarding Cayetano&#8217;s initial statements, who, when he got out of the vehicle, commented that <strong data-start=\"3723\" data-end=\"3757\">&#8220;his brakes had failed&#8221;,<\/strong> Moeckel considers that it was <strong data-start=\"3785\" data-end=\"3840\">a spontaneous and confused reaction after the accident<\/strong>. <span style=\"font-size: 16px;\">&#8220;That&#8217;s not where I come in. I think it should be a lack of attention more than anything else, and already at that point, absent-minded, I wouldn&#8217;t know which pedal I was hitting. An absent-mindedness. But yes, the brakes could have failed, or it could also be that what failed was the reflex of stepping on the brake. And there is no more story,&#8221; explains the lawyer.<\/span><\/p>\n<p data-start=\"4164\" data-end=\"4349\">The lawyer considers that the media hype is mainly due to the <strong data-start=\"4238\" data-end=\"4257\">fame of the bullfighter<\/strong>: &#8220;His name is Cayetano Rivera; if his name were Joaqu\u00edn Mart\u00edn, nobody would have talked about this&#8221;.<\/p>\n<h2 data-start=\"4356\" data-end=\"4391\">&#8220;There is no reason for lawsuits.&#8221;<\/h2>\n<p data-start=\"4393\" data-end=\"4476\">Asked if the bullfighter will take any legal action, Moeckel is categorical: <span style=\"font-size: 16px;\">&#8220;What lawsuit am I going to file? This has only just begun. Now the proceedings are starting to verify the facts of the accident, the investigation to find out what happened and how the events unfolded. This has little history. And I imagine it will come to nothing,&#8221; says Moeckel.<\/span><\/p>\n<h2 data-start=\"5142\" data-end=\"5216\">&#8220;The police investigate, but the judges are the ones who pass sentence.&#8221;<\/h2>\n<p data-start=\"5218\" data-end=\"5366\">In statements to <strong data-start=\"5250\" data-end=\"5268\">Sonsoles \u00d3nega&#8217;<\/strong> s program on <em data-start=\"5272\" data-end=\"5282\">Antena 3<\/em>, Moeckel wanted to emphasize that police work does not imply automatic guilt: <span style=\"font-size: 16px;\">&#8220;Fortunately, the police investigate, but they are not the ones who pass sentence. That is what magistrates and judges are for. One thing is that the police can understand that there has been disobedience and another that in the end it is true that there has been disobedience or not.
