Insular de Ibiza<\/strong> has responded to the recent sentence that <a href=\"https:\/\/lavozdeibiza.com\/en\/current-news\/setback-to-the-fight-against-tourist-rentals-a-ruling-allows-the-rental-of-rooms-through-airbnb\/?swcfpc=1\">annulled a sanction for renting a room for tourist purposes<\/a>, clarifying that this is a<strong>very specific case and prior to the current regulatory changes<\/strong>.<\/p>\n<ul>\n<li data-start=\"318\" data-end=\"691\">\n<h5><a href=\"https:\/\/lavozdeibiza.com\/en\/current-news\/setback-to-the-fight-against-tourist-rentals-a-ruling-allows-the-rental-of-rooms-through-airbnb\/?swcfpc=1\">Setback to the fight against tourist rentals: a ruling allows the rental of rooms through Airbnb<\/a><\/h5>\n<\/li>\n<\/ul>\n<p data-start=\"318\" data-end=\"691\">The institution stresses that the court ruling does not establish jurisprudence nor can it be used as a basis for reversing other sanctions, as they explained to <strong><a href=\"https:\/\/lavozdeibiza.com\/en\/\">La Voz de Ibiza.<\/a><\/strong><\/p>\n<p data-start=\"780\" data-end=\"1130\">The sentence of the Court of Administrative Litigation number 2 of Palma -which annulled a fine of the Consell for renting a room in a habitual residence- has been described by the insular institution as <strong data-start=\"1000\" data-end=\"1026\">&#8220;a very specific case&#8221;,<\/strong> which does not reflect the majority of proceedings opened by the <strong data-start=\"1088\" data-end=\"1129\">Office for Combating Intrusiveness<\/strong>.<\/p>\n<p data-start=\"1132\" data-end=\"1494\">&#8220;The person responsible for having put that room on the tourist market continued to live in that apartment while the tourist rental was being committed,&#8221; the Consell points out.<\/p>\n<p data-start=\"1132\" data-end=\"1494\">According to their criteria, this type of situation <strong data-start=\"1344\" data-end=\"1408\">is not representative of the bulk of the sanctioning files<\/strong>, which usually refer to <strong data-start=\"1433\" data-end=\"1494\">rentals of entire dwellings in an irregular situation<\/strong>.<\/p>\n<h2 data-start=\"1501\" data-end=\"1578\">The new legal framework closes the door<\/h2>\n<p data-start=\"1580\" data-end=\"2032\">The insular institution also emphasizes that <strong data-start=\"1642\" data-end=\"1708\">the regulations have changed substantially since the case in court<\/strong>, corresponding to a sanction prior to <strong data-start=\"1751\" data-end=\"1759\">2021<\/strong>.<\/p>\n<ul>\n<li data-start=\"301\" data-end=\"568\">\n<h5><a the recent entry into force of <strong data-start=\"1825\" data-end=\"1891\">Regulation (EU) 2024\/1028 of the European Parliament and of the Council<\/strong>, which requires <strong data-start=\"1910\" data-end=\"1980\">all tourist rental activities to have a registration number<\/strong>, marks a new regulatory scenario throughout Spain.<\/p>\n<p data-start=\"2034\" data-end=\"2423\">In the specific case of <strong>Ibiza<\/strong>, this legal requirement is also reinforced by <strong data-start=\"2112\" data-end=\"2178\">agreements signed between the Consell and digital platforms<\/strong> to prevent the marketing of accommodations that do not have a registration number <strong data-start=\"2269\" data-end=\"2315\">issued by the institution or by the State<\/strong>.<\/p>\n<p data-start=\"2034\" data-end=\"2423\">Therefore, the option of renting rooms on portals such as <em>Airbnb<\/em> without registration would no longer be viable.<\/p>\n<p data-start=\"2505\" data-end=\"2965\">On the other hand, the Consell also recalls that the <strong data-start=\"2540\" data-end=\"2583\">latest amendment to the Tourism Law<\/strong>, promoted by the Government of Marga Prohens, &#8220;eliminates any possibility of tourist rental in tourist apartments and, therefore, <strong>closes the door to be able to claim any kind of lack of definition of what is and what is not a tourist apartment and what is allowed and what is not&#8221;. <\/strong> <\/p>\n<ul>\n<li data-start=\"2533\" data-end=\"3021\">\n<h5><a href=\"https:\/\/lavozdeibiza.com\/actualidad\/agentes-contra-el-intrusismo-la-figura-pionera-que-ya-trabaja-en-ibiza-y-que-ha-abierto-decenas-de-expedientes-por-alquiler-ilegal\/?swcfpc=1\">Agents sentence does not create jurisprudence&#8221;,<\/strong> and that it <strong data-start=\"3150\" data-end=\"3218\">cannot be used as an argument to challenge other sanctions<\/strong> imposed in example of the great bulk of disciplinary proceedings for infractions of tourism management that are processed in this institution&#8221;.<\/strong><\/p>\n<h2 data-start=\"6218\"
