The resolution, which marks a new direction in the case, comes after an investigation that has been surrounded by media controversy, judicial tension and a strong social debate. <\/p>\n<p data-start=\"795\" data-end=\"1163\">After the decision was made public, Moulia\u00e1&#8217;s lawyer, <strong data-start=\"852\" data-end=\"870\">Alfredo Arrien<\/strong>, celebrated the judicial advance in a conversation with <em>EL PA\u00cdS<\/em>: <em data-start=\"900\" data-end=\"1084\">&#8220;We have received it with joy. Elisa believes more and more in justice, although let&#8217;s not forget that her path has been long and tedious and the worst thing is that almost nobody outside has believed in her&#8221;.<\/em> Errej\u00f3n&#8217;s defense, for its part, has confirmed that it <strong data-start=\"1141\" data-end=\"1154\">will appeal<\/strong> the order. <\/p>\n<h2 data-start=\"1170\" data-end=\"1235\"><strong data-start=\"1173\" data-end=\"1235\">The statement of the actress, central axis of the prosecution<\/strong><\/h2>\n<p data-start=\"1237\" data-end=\"1584\">In his resolution, Judge Carretero points out that <em data-start=\"1284\" data-end=\"1476\">&#8220;in the absence of eyewitnesses to the facts and with some reference testimonies and expert evidence, the main evidence is the statement of the injured party&#8221;.<\/em> The order adds that <em data-start=\"1496\" data-end=\"1583\">&#8220;her statement is essentially coherent, although she does not remember secondary details&#8221;.<\/em> <\/p>\n<ul>\n<li>\n<h5><a href=\"https:\/\/lavozdeibiza.com\/actualidad\/una-sesion-de-tatuaje-que-acabo-en-denuncia-por-agresion-sexual-en-ibiza\/?swcfpc=1\">A tattoo session that ended in a sexual assault complaint in Ibiza<\/a><\/h5>\n<\/li>\n<\/ul>\n<p data-start=\"1586\" data-end=\"2040\">The defense of the actress especially emphasizes that the judge gave essential value to the testimony of Moulia\u00e1: <em data-start=\"1688\" data-end=\"1963\">&#8220;Her story has managed to convince a judge who is not especially the champion of feminism, far from it. The magistrate&#8217;s questions and comments, such as <em data-start=\"2369\" data-end=\"2399\">&#8220;She was very drunk, are you sure?&#8221;,<\/em> <em data-start=\"2401\" data-end=\"2430\">&#8220;He said to her: &#8216;leave me alone?'&#8221;,<\/em> <em data-start=\"2432\" data-end=\"2480\">&#8220;it is not understood that you did not make a gesture&#8221;<\/em> or <em data-start=\"2483\" data-end=\"2613\">&#8220;you are a woman used to dealing with the public, how are you not able to tell her that those conditions were not acceptable?&#8221;,<\/em> provoked protests from the feminist movement and even a disciplinary file that was filed a month ago. <\/p>\n<h2 data-start=\"2736\" data-end=\"2798\"><strong data-start=\"2739\" data-end=\"2798\">The night of the events: the testimony of the complainant<\/strong><\/h2>\n<p data-start=\"2800\" data-end=\"3378\">According to Moulia\u00e1&#8217;s account, everything happened in <strong data-start=\"2844\" data-end=\"2866\">September 2021<\/strong>, when the two attended a party together after a presentation of Errej\u00f3n&#8217;s book. The actress states that the politician <g id=\"gid_1\">kissed<\/g> her <g id=\"gid_1\">without consent in an elevator<\/g>, <g id=\"gid_2\">took<\/g> her <g id=\"gid_2\">to a room<\/g>, where he <g id=\"gid_3\">closed the latch<\/g> and, always according to her version, performed <g id=\"gid_4\">&#8220;numerous touches without her consent, even taking out &#8216;his virile member'&#8221;.<\/g> Later, at the politician&#8217;s home, he allegedly tried to have sex again, at which point she reproached him for his behavior.  <\/p>\n<ul>\n<li>\n<h5><a href=\"https:\/\/lavozdeibiza.com\/actualidad\/sant-antoni-explica-por-que-no-pudo-retirar-la-licencia-al-taxista-condenado-por-agresion-sexual\/?swcfpc=1\">Sant Antoni explains why it could not withdraw the license of the cab driver convicted of sexual assault<\/a><\/h5>\n<\/li>\n<\/ul>\n<p data-start=\"3380\" data-end=\"3817\">The judge held that the victim <em data-start=\"3412\" data-end=\"3495\">&#8220;before the facts, had no spurious motive, enmity, hatred or revenge&#8221;,<\/em> that <em data-start=\"3501\" data-end=\"3547\">&#8220;her statement is essentially coherent&#8221;<\/em> and that <em data-start=\"3554\" data-end=\"3642\">&#8220;the delay in the complaint is a fact to be taken into account, but does not imply that it is false&#8221;.<\/em> According to Moulia\u00e1&#8217;s statement, she delayed in filing the complaint because of <em data-start=\"3690\" data-end=\"3816\">&#8220;fear of the personality of the accused and only when she saw that other women were commenting on similar facts in the media&#8221;.<\/em> <\/p>\n<h2 data-start=\"3824\" data-end=\"3892\"><strong data-start=\"3827\" data-end=\"3892\">From politics to the criminal case: the context of the Errej\u00f3n case<\/strong><\/h2>\n<p data-start=\"3894\" data-end=\"4305\">The prosecution comes at a complex time for the former leader of Podemos and M\u00e1s Madrid. In <strong data-start=\"3993\" data-end=\"4012\">October 2024<\/strong>, Errej\u00f3n left politics after allegations of inappropriate behavior with several women.
