The facts judged occurred in the early morning of August 3, 2023 in a house located in <strong data-start=\"840\" data-end=\"855\">ses Pa\u00efsses<\/strong>, in the municipality of <strong data-start=\"876\" data-end=\"891\">Sant Antoni<\/strong>, where the victims lived. <\/p>\n<ul>\n<li data-start=\"496\" data-end=\"922\">\n<h5><a href=\"https:\/\/lavozdeibiza.com\/en\/current-news\/a-popular-jury-tries-a-woman-for-killing-an-elderly-man-by-setting-fire-to-his-house-in-ibiza\/?swcfpc=1\">A popular jury tries a woman for killing an elderly man by setting fire to his house in Ibiza<\/a><\/h5>\n<\/li>\n<\/ul>\n<p data-start=\"924\" data-end=\"1307\"><strong data-start=\"924\" data-end=\"998\">The prosecution argues that the defendant acted with premeditation and malice aforethought<\/strong>, setting fire to the home with the clear intent to kill the man, according to the opening statement of the trial.<\/p>\n<p data-start=\"924\" data-end=\"1307\">For this reason, he is requesting a permanent revisable prison sentence for a crime of murder and another of arson, as well as compensation of 273,289 euros to the family of the deceased.<\/p>\n<h2 data-start=\"1309\" data-end=\"1358\"><strong data-start=\"1313\" data-end=\"1358\">Perverse&#8221; plan  <\/strong><\/h2>\n<p data-start=\"1360\" data-end=\"1754\">During the oral hearing, which began with the reading of the prosecution and defense briefs, both the <strong data-start=\"1464\" data-end=\"1485\">prosecution<\/strong> and the <strong data-start=\"1494\" data-end=\"1518\">private prosecution<\/strong> agreed that I.C.N. set fire to the house &#8220;with the intention of ending the lives&#8221; of its occupants.<\/p>\n<p data-start=\"1360\" data-end=\"1754\">One of them, 77-year-old Francisco L\u00f3pez Mena, <strong data-start=\"1671\" data-end=\"1708\">died of asphyxiation and burns<\/strong> because he was unable to escape due to his disability.<\/p>\n<p data-start=\"1756\" data-end=\"2160\">According to the prosecution, between 01:30 and 02:00 a.m., <strong data-start=\"1820\" data-end=\"1917\">the defendant left her home covering her face, as shown by security cameras<\/strong>, and walked to the victims&#8217; home, to which she gained access using a key.<\/p>\n<p data-start=\"1756\" data-end=\"2160\"><strong data-start=\"2009\" data-end=\"2071\">She maintained a sentimental relationship with the son of the deceased<\/strong>, who at the time was admitted to the psychiatric ward of the Can Misses hospital.<\/p>\n<p data-start=\"2162\" data-end=\"2487\">Once inside, he <strong data-start=\"2178\" data-end=\"2242\">set fire with a lighter or a match to the sofa in the living room<\/strong> and placed some cushions in the garage, right next to the vehicle&#8217;s engine, which were also set on fire. Francisco slept in one of the rooms, while his wife Antonia, 74 years old and suffering from Alzheimer&#8217;s, was rescued with a caregiver.<\/p>\n<p data-start=\"2489\" data-end=\"2813\">The man died from <strong data-start=\"2509\" data-end=\"2549\">carbon monoxide poisoning<\/strong> and <strong data-start=\"2552\" data-end=\"2605\">second-degree burns over 80% of his body<\/strong>, according to expert evidence. The doors of the house were not forced, and the keys were only in the possession of the children, in addition to the defendant, who had lived in the house until July of the same year.<\/p>\n<p>In addition, the prosecutor stated that the defendant &#8220;leaves her doorway covering herself so as not to be seen by the camera, wearing black glasses and a zebra bag. When she returns at 2:31 a.m. she comes back with different clothes, but with the same sneakers and the same bag&#8221;.<\/p>\n<p>In addition, he said that these &#8220;slippers and purse were found in the house search of the accused&#8221;, who has not yet provided &#8220;any official version of what she did that night&#8221;.<\/p>\n<p><strong>&#8220;There is no alibi<\/strong>,&#8221; he said.<\/p>\n<ul>\n<li>\n<h5><a href=\"https:\/\/lavozdeibiza.com\/en\/current-news\/immigrants-arrested-for-robbery-in-formentera-held-a-party-on-a-terrace-for-more-than-an-hour\/?swcfpc=1\">Immigrants arrested for robbery in Formentera held a party on a terrace for more than an hour<\/a><\/h5>\n<\/li>\n<\/ul>\n<p data-start=\"4291\" data-end=\"4581\">The prosecutor pointed out that the evidence is found in <strong data-start=\"4320\" data-end=\"4362\">54 security camera recordings<\/strong> that show her leaving and returning to her home between 1:04 and 2:31 wearing different clothes, but <strong data-start=\"4477\" data-end=\"4510\">the same sneakers and purse<\/strong>.<\/p>\n<p data-start=\"4583\" data-end=\"4848\">Likewise, one of the agents declared that <strong data-start=\"4624\" data-end=\"4656\">the fire was intentional<\/strong>, and that I.C.N., despite suffering from schizoaffective disorder, &#8220;<strong data-start=\"4718\" data-end=\"4754\">knew perfectly well what he was doing<\/strong> and had the will to do it&#8221;, without showing any nervousness or empathy at the time of the events.<\/p>\n<h2 data-start=\"2815\" data-end=\"2874\"><strong data-start=\"2819\" data-end=\"2874\">The defense denies authorship and speaks of &#8220;conjecture&#8221;.<\/strong><\/h2>\n<p data-start=\"2876\" data-end=\"3199\">For its part, the <strong data-start=\"2893\" data-end=\"2914\">defense of I.C.N.<\/strong> &#8220;expressly and categorically&#8221; denied its involvement in the facts, describing the accusation as unfounded.<\/p>\n<p>&#8220;The accusation that they maintain towards my client is not real,  <strong>is being unfairly accused<\/strong>&#8220;The defense attorney pointed out that the jury has &#8220;a very big responsibility, that the defendant loses her freedom or recovers it&#8221;.<\/p>\n<p>In addition, he said that<strong>&#8220;I am convinced of my innocence<\/strong>&#8221; and that the accusation was born &#8220;because of a personal suspicion: one of the daughters says &#8216;I suspect I'&#8221;.<\/p>\n<p>Regarding his client&#8217;s silence, he explained that &#8220;the defense does not have to prove innocence. It is the prosecution that has to prove it. They are opinions, suspicions, doubts, but he has not demonstrated anything firm&#8221;.<\/p>\n<p>He also argued at the hearing that &#8220;n<strong>no evidence has been requested during the investigation. There is nothing. I don&#8217;t know how it got here.&#8221;  <\/strong>.<\/p>\n<p>In addition, he has remarked some &#8220;<strong>contradictions<\/strong>&#8221; in how the fire was started and in the times when the accused allegedly goes to the house. He criticized the fact that <strong data-start=\"3729\" data-end=\"3808\">in the more than two years of investigation no key evidence had been requested<\/strong> and defended the principle of presumption of innocence. &#8220;When in doubt, you can&#8217;t convict,&#8221; he stressed.<\/p>\n<h2 data-start=\"4850\" data-end=\"4896\"><strong data-start=\"4854\" data-end=\"4896\">The trial will continue for eight days<\/strong><\/h2>\n<p data-start=\"4898\" data-end=\"5246\">The oral hearing will last for <strong data-start=\"4934\" data-end=\"4977\">eight sessions spread over two weeks<\/strong>, during which testimony and expert evidence will be heard.
