The decision, adopted this Tuesday by the magistrate of the Supreme Court <strong data-start=\"646\" data-end=\"665\">Leopoldo Puente<\/strong>, comes after the instructor considers that the risk of destruction of evidence (the reason that justified his entry into prison last June 30) has been substantially reduced. <\/p>\n<p data-start=\"858\" data-end=\"1125\">Even so, the judge emphasizes that the indications pointing to the possible involvement of the former socialist leader in crimes of <strong data-start=\"978\" data-end=\"1037\">criminal organization, bribery and influence peddling<\/strong> have not only not disappeared, but have been reinforced during the investigation.<\/p>\n<h2>The Supreme Court&#8217;s reasons: mitigated risk, enhanced indicia of guilt<\/h2>\n<p data-start=\"1236\" data-end=\"1672\">In an extensive order, Judge Puente concludes that the risk that Cerd\u00e1n could <strong data-start=\"1316\" data-end=\"1378\">&#8220;hide, alter or destroy relevant sources of evidence&#8221;,<\/strong> which was &#8220;very intense&#8221; when he was sent to prison, <strong data-start=\"1442\" data-end=\"1482\">&#8220;appears to have been seriously mitigated&#8221;<\/strong> due to the progress of the investigations. He points out that access has been gained to information that &#8220;very probably&#8221; would have been &#8220;occluded or very difficult to access&#8221; in the early stages of the case. <\/p>\n<ul>\n<li>\n<h5><a href=\"https:\/\/lavozdeibiza.com\/en\/current-news\/the-uco-report-on-the-koldo-case-reveals-payments-in-ibiza-linked-to-santos-cerdans-entourage\/?swcfpc=1\">The UCO report on the &#8216;Koldo case&#8217; reveals payments in Ibiza linked to Santos Cerd\u00e1n&#8217;s entourage.<\/a><\/h5>\n<\/li>\n<\/ul>\n<p data-start=\"1674\" data-end=\"1968\">In spite of this, the magistrate emphasizes that <strong data-start=\"1713\" data-end=\"1967\">&#8220;the result of the investigation carried out has not only not diluted the consistent evidence of criminality already in the case, but, on the contrary, it has reinforced it to a great extent and opened new lines of investigation&#8221;.<\/strong><\/p>\n<p data-start=\"1970\" data-end=\"2199\">However, the existence of these indications, clarifies the instructor, <strong data-start=\"2038\" data-end=\"2067\">does not justify by itself<\/strong> the maintenance of pre-trial detention if there are no other risks such as flight, criminal repetition or destruction of evidence.<\/p>\n<h2>No flight risk and no possibility of repeat offenses<\/h2>\n<p data-start=\"2307\" data-end=\"2573\">The judge ruled out that there is a risk of criminal repetition because the investigated <strong data-start=\"2389\" data-end=\"2572\">&#8220;does not currently hold any public office, nor does he maintain any organic relationship of management with the political party of which he was, at the time, Secretary of Organization&#8221;.<\/strong><\/p>\n<p data-start=\"2575\" data-end=\"2967\">Nor does it appreciate a high risk of flight. The order explains that <g id=\"gid_0\">&#8220;it does not identify the presence of a certain and marked risk of flight or possible evasion of justice&#8221;,<\/g> although it recognizes that it is a scenario that &#8220;can never be completely or absolutely ruled out&#8221;. For this reason, he points out that it can be neutralized by less restrictive measures than imprisonment.  <\/p>\n<ul>\n<li>\n<h5><a href=\"https:\/\/lavozdeibiza.com\/actualidad\/la-uco-irrumpe-en-la-sede-del-psoe-para-clonar-el-correo-de-santos-cerdan-en-plena-investigacion-judicial\/?swcfpc=1\">The UCO breaks into the PSOE headquarters to clone Santos Cerd\u00e1n&#8217;s mail in the middle of a judicial investigation.<\/a><\/h5>\n<\/li>\n<\/ul>\n<p data-start=\"2969\" data-end=\"3164\">Regarding the destruction of evidence, Puente considers that the danger has been reduced after months of investigation and after the investigators have managed to secure key documentation.<\/p>\n<h2>Precautionary measures to be complied with by Santos Cerd\u00e1n<\/h2>\n<p data-start=\"3269\" data-end=\"3470\">Despite authorizing his release, the Supreme Court imposed a series of precautionary measures to guarantee his availability before the courts and prevent any attempt to evade criminal proceedings.<\/p>\n<p data-start=\"3472\" data-end=\"3493\">These include:<\/p>\n<ul data-start=\"3495\" data-end=\"3837\">\n<li data-start=\"3495\" data-end=\"3609\">\n<p data-start=\"3497\" data-end=\"3609\"><strong data-start=\"3497\" data-end=\"3541\">Mandatory appearances every 15 days<\/strong> before the Supreme Court or the court closest to your home.<\/p>\n<\/li>\n<li data-start=\"3610\" data-end=\"3680\">\n<p data-start=\"3612\" data-end=\"3680\"><strong data-start=\"3612\" data-end=\"3659\">Obligation to attend whenever summoned<\/strong> by the Criminal Court.<\/p>\n<\/li>\n<li data-start=\"3681\" data-end=\"3734\">\n<p data-start=\"3683\" data-end=\"3734\"><strong data-start=\"3683\" data-end=\"3731\">Prohibition to leave the national territory<\/strong>.<\/p>\n<\/li>\n<li data-start=\"3735\" data-end=\"3837\">\n<p data-start=\"3737\" data-end=\"3837\"><strong data-start=\"3737\" data-end=\"3763\">Withdrawal of the passport<\/strong>, which must be delivered to the Secretariat of the Criminal Chamber of the High Court.<\/p>\n<\/li>\n<\/ul>\n<p data-start=\"3839\" data-end=\"4036\">These measures, the judge remarked, respond to the need to ensure his presence in the case &#8220;in view of the persistence and strengthening of the consistent indications of the commission of criminal acts&#8221;.<\/p>\n<h2>The context of the Koldo case and its role in the case<\/h2>\n<p data-start=\"4135\" data-end=\"4371\">The investigation in which Santos Cerd\u00e1n is accused revolves around the <strong data-start=\"4207\" data-end=\"4303\">alleged rigging of public contracts for the supply of health material during the pandemic<\/strong>, a case that has affected several public officials and businessmen.<\/p>\n<p data-start=\"4373\" data-end=\"4598\">Cerd\u00e1n, one of the key figures in the PSOE during the Pedro S\u00e1nchez administration, was arrested on June 30. Since then he has remained in custody due to fears that he could interfere in the investigation. <\/p>\n<ul>\n<li>\n<h5><a href=\"https:\/\/lavozdeibiza.com\/actualidad\/dimite-santos-cerdan-y-abre-una-crisis-en-el-nucleo-duro-de-pedro-sanchez\/?swcfpc=1\">Santos Cerdan resigns and opens a crisis in Pedro Sanchez&#8217;s hard core<\/a><\/h5>\n<\/li>\n<\/ul>\n<p data-start=\"4600\" data-end=\"4789\">In recent weeks, the progress of the investigations and the collection of relevant documentation and testimonies have led the Supreme Court to reconsider the harshness of the initial precautionary measure.<\/p>\n<h2>What will happen now<\/h2>\n<p data-start=\"4857\" data-end=\"5172\">After leaving prison, Santos Cerd\u00e1n must strictly comply with the measures imposed and remain at the disposal of the Supreme Court while the investigation of the case continues.
