data-end=\"774\">Supreme Court<\/strong>, meeting this Thursday in <strong data-start=\"799\" data-end=\"809\">Madrid<\/strong>, has sentenced the Attorney General of the State, <strong data-start=\"854\" data-end=\"877\">\u00c1lvaro Garc\u00eda Ortiz<\/strong>, to <strong data-start=\"881\" data-end=\"911\">two years of disqualification<\/strong> and a fine of 7,200 euros for <strong data-start=\"945\" data-end=\"984\">a crime of disclosure of secrets<\/strong> committed in <strong data-start=\"997\" data-end=\"1014\">March 2024<\/strong> by disseminating confidential data of the businessman <strong data-start=\"1059\" data-end=\"1086\">Alberto Gonz\u00e1lez Amador<\/strong>, partner of the Madrid president Isabel D\u00edaz Ayuso, as communicated by the high court itself in a ruling advanced to the parties.<\/p>\n<ul>\n<li data-start=\"751\" data-end=\"1216\">\n<h4><a href=\"https:\/\/lavozdeibiza.com\/en\/society\/the-audios-of-prosecutor-ignacio-stampa-uncover-a-secret-meeting-with-a-former-psoe-militant-who-claimed-to-be-acting-on-behalf-of-the-party\/?swcfpc=1\">The data-end=\"1258\"><strong data-start=\"1226\" data-end=\"1258\">Dissenting vote condemnation<\/strong><\/h2>\n<p data-start=\"1259\" data-end=\"1755\">The ruling, advanced before the sentence was drafted, was approved by <strong data-start=\"1339\" data-end=\"1367\">five votes to two<\/strong>, with the support of judges Andr\u00e9s Mart\u00ednez Arrieta, Manuel Marchena, Jos\u00e9 Ram\u00f3n Berdugo, Antonio del Moral and Carmen Lamela. <strong data-start=\"1498\" data-end=\"1542\">Magistrates Ana Ferrer and Susana Polo<\/strong>, with a progressive profile, announced a dissenting vote. <strong data-start=\"1595\" data-end=\"1603\">Polo<\/strong>, the initial rapporteur of the case, was replaced by Mart\u00ednez Arrieta due to her disagreement with the majority, a move that <strong data-start=\"1726\" data-end=\"1752\">marks a judicial milestone<\/strong>.<\/p>\n<p data-start=\"1757\" data-end=\"2082\">In this context, <strong data-start=\"1775\" data-end=\"1815\">the court&#8217;s conservative majority<\/strong> ruled just a week after the conclusion of a trial considered <strong data-start=\"1894\" data-end=\"1907\">historic<\/strong>, as it was the first time an attorney general sat in the dock.<\/p>\n<h2 data-start=\"2089\" data-end=\"2124\"><strong data-start=\"2092\" data-end=\"2124\">Fragment of the known ruling<\/strong><\/h2>\n<p data-start=\"2125\" data-end=\"2526\">So far only the decisive paragraph has been released: <strong data-start=\"2179\" data-end=\"2330\">&#8220;We must and do condemn Garc\u00eda Ortiz (&#8230;) to a fine of 12 months with a daily fee of 20 euros and special disqualification for 2 years&#8221;.<\/strong> Article 417.1 of the Penal Code punishes anyone who, being an authority or civil servant, discloses <strong data-start=\"2424\" data-end=\"2444\">reserved data<\/strong> that should not be disclosed, with penalties of between one and three years of disqualification. <\/p>\n<p data-start=\"2528\" data-end=\"2770\">The court also recognized <strong data-start=\"2557\" data-end=\"2590\">10,000 euros in moral damages<\/strong> to Gonzalez Amador, far short of the <strong data-start=\"2627\" data-end=\"2652\">300,000 claimed<\/strong> by the private prosecution.<\/p>\n<h2 data-start=\"2777\" data-end=\"2807\"><strong data-start=\"2780\" data-end=\"2807\">Confronting accusations<\/strong><\/h2>\n<p data-start=\"2808\" data-end=\"3218\">In the trial, <strong data-start=\"2834\" data-end=\"2855\">seven accusations<\/strong> coincided in asking for a conviction -among them the Professional and Independent Association of Prosecutors (APIF), the Bar Association of Madrid (ICAM), Manos Limpias and the unified popular accusation led by the Freedom and Alternative Forum Foundation, which includes Vox and Hazte O\u00edr- against the <strong data-start=\"3147\" data-end=\"3184\">Prosecutor&#8217;s Office and the State Attorney&#8217;s Office<\/strong>, which requested an acquittal.<\/p>\n<p data-start=\"3220\" data-end=\"3462\">Gonzalez Amador&#8217;s lawyer asked for <strong data-start=\"3256\" data-end=\"3282\">four years in prison<\/strong>, three years of disqualification and a fine of 108,000 euros. <strong data-start=\"3337\" data-end=\"3345\">APIF<\/strong>, tougher, demanded <strong data-start=\"3365\" data-end=\"3413\">six years in prison and twelve years of disqualification<\/strong>, even pointing to a crime of prevarication.<\/p>\n<h2 data-start=\"3469\" data-end=\"3522\"><strong data-start=\"3472\" data-end=\"3522\">Leaks and internal memos<\/strong><\/h2>\n<p data-start=\"3523\" data-end=\"3880\">The process examined two facts: <strong data-start=\"3554\" data-end=\"3596\">the alleged leak to <em>Cadena SER<\/em><\/strong>, on the night of March 13, 2024, of the mail sent by the businessman&#8217;s defense on February 2 offering to acknowledge two tax crimes; and the <strong data-start=\"3749\" data-end=\"3791\">press release issued by the Prosecutor&#8217;s Office<\/strong> at 10:22 a.m. on March 14 to deny a previous information from <em data-start=\"3867\" data-end=\"3877\">El Mundo<\/em>.<\/p>\n<p data-start=\"3882\" data-end=\"4061\">Although the Supreme Court initially ruled out that this note was a criminal offense, the investigator \u00c1ngel Hurtado later reincorporated it into the case, which generated an <strong data-start=\"4032\" data-end=\"4060\">unexpected procedural twist<\/strong>.<\/p>\n<h2 data-start=\"4068\" data-end=\"4123\"><strong data-start=\"4071\" data-end=\"4123\">Key testimonies and reconstruction of events<\/strong><\/h2>\n<p data-start=\"4124\" data-end=\"4479\">During the six days of oral hearings, more than <strong data-start=\"4182\" data-end=\"4197\">40 witnesses<\/strong> testified, including journalists who claimed to know the information before Garc\u00eda Ortiz received the leaked email at 21.59. <strong data-start=\"4327\" data-end=\"4346\">Almudena Lastra<\/strong>, head of the Superior Prosecutor&#8217;s Office of Madrid, said that she warned the attorney general: <strong data-start=\"4427\" data-end=\"4458\">&#8220;\u00c1lvaro, did you leak?&#8221;,<\/strong> something he denied <strong data-start=\"4427\" data-end=\"4458\">.<\/strong><\/p>\n<p data-start=\"4481\" data-end=\"4730\">The defense argued that the only accredited leak was an email sent by prosecutor Juli\u00e1n Salto on March 12, which ended up being forwarded to Ayuso&#8217;s chief of staff, Miguel \u00c1ngel Rodr\u00edguez, who disseminated it &#8220;among journalists as of 7:00 p.m.&#8221;.<\/p>\n<p data-start=\"4778\" data-end=\"5206\">The attorney general proclaimed his <strong data-start=\"4808\" data-end=\"4821\">innocence<\/strong> and defended that he acted out of his &#8220;obsession&#8221; with clarifying what happened and protecting the institution from what he considered a <strong data-start=\"4944\" data-end=\"4971\">smear campaign<\/strong>.
