A judge in Madrid has ordered him to pay <strong data-start=\"899\" data-end=\"916\">853,732 euros<\/strong> to his brother \u00cd\u00f1igo for his share of the price obtained after the sale of the canvas <em data-start=\"1014\" data-end=\"1053\">Portrait of Valent\u00edn Belv\u00eds de Moncada<\/em>, acquired by businessman <strong data-start=\"1083\" data-end=\"1109\">Juan Miguel Villar Mir<\/strong> in 2012 for <strong data-start=\"1122\" data-end=\"1147\">5.8 million euros.<\/strong> <\/p>\n<p data-start=\"1150\" data-end=\"1558\">The sentence, advanced by <em data-start=\"1179\" data-end=\"1192\">eldiario.es<\/em> and reported by <em>EFE<\/em>, details how this sale was agreed between the brothers to solve the serious economic problems of the first-born, Count of Bornos, whose debt amounted to <strong data-start=\"1368\" data-end=\"1391\">7 million euros<\/strong>. To this end, five of the Ram\u00edrez de Haro brothers met in 2012 and agreed to part with the work by <strong data-start=\"1501\" data-end=\"1522\">Francisco de Goya<\/strong>, a historical piece of great value. <\/p>\n<h2 data-start=\"1560\" data-end=\"1618\"><strong data-start=\"1563\" data-end=\"1618\">The signed agreement: &#8220;legally valid and effective&#8221;.<\/strong><\/h2>\n<p data-start=\"1619\" data-end=\"2082\">The judge considers it proven that Aguirre&#8217;s husband committed in writing, on <strong data-start=\"1701\" data-end=\"1723\">January 9, 2014<\/strong>, to deliver to each of his four siblings, and to the daughter of the deceased brother, the proportional part of the money obtained from the sale of the painting. A commitment that, according to the resolution, is <strong data-start=\"1928\" data-end=\"1963\">&#8220;legally valid and effective&#8221;,<\/strong> although it was subject to the economic availability of Fernando Ramirez de Haro and did not set a specific deadline. <\/p>\n<p data-start=\"2084\" data-end=\"2349\">This nuance was key. Although the defense argued that no date for payment had been stipulated, the judge cited <g id=\"gid_0\">article 1128 of the Civil Code<\/g>, which allows the judge to determine deadlines when they have not been set. Consequently, the debt is <strong data-start=\"2336\" data-end=\"2348\">due and payable<\/strong>.  <\/p>\n<ul>\n<li>\n<h5><a href=\"https:\/\/lavozdeibiza.com\/en\/current-news\/the-mysterious-death-of-flor-bollini-in-ibiza-the-family-speaks-of-manipulation-express-cremation-and-a-very-great-power-behind-it\/?swcfpc=1\">The mysterious death of Flor Bollini in Ibiza: the family speaks of manipulation, express cremation and &#8220;a very great power&#8221; behind it.<\/a><\/h5>\n<\/li>\n<\/ul>\n<p data-start=\"2351\" data-end=\"2651\">The magistrate summarizes the situation as follows: <strong data-start=\"2392\" data-end=\"2551\">&#8220;The absence of establishing a time limit and the means of accrediting the economic availability does not prevent the enforceability of the debt&#8221;,<\/strong> since a &#8220;prudential&#8221; time has passed and there have been &#8220;various proposals to make it effective&#8221;.<\/p>\n<p data-start=\"2351\" data-end=\"2651\">In addition to the principal amount, the judge ordered Aguirre&#8217;s husband to pay <strong data-start=\"2750\" data-end=\"2773\">interest for late payment<\/strong>, which will be fixed during the execution phase.<\/p>\n<h2 data-start=\"2813\" data-end=\"2874\"><strong data-start=\"2816\" data-end=\"2874\">Three mail complaints and one lawsuit filed<\/strong><\/h2>\n<p data-start=\"2875\" data-end=\"3304\">Despite the written agreement, Fernando Ram\u00edrez de Haro <strong data-start=\"2929\" data-end=\"2943\">never paid<\/strong>. His brother \u00cd\u00f1igo claimed the debt up to <g id=\"gid_1\">three times by email<\/g> in 2019. When he did not receive a satisfactory response, he filed a <strong data-start=\"3094\" data-end=\"3120\">criminal complaint in 2020<\/strong>, in which he accused him of multiple crimes: false documentation, fraud, misappropriation, misappropriation of assets, unfair administration, money laundering and corporate crime.  <\/p>\n<p data-start=\"3306\" data-end=\"3508\">That criminal proceeding was closed in 2023. However, the civil proceeding &#8211; the one we are now dealing with &#8211; has continued to move forward until it resulted in this ruling, which can still be appealed. <\/p>\n<h2 data-start=\"3510\" data-end=\"3552\"><strong data-start=\"3513\" data-end=\"3552\">A long-standing controversy<\/strong><\/h2>\n<p data-start=\"3553\" data-end=\"3945\">The family conflict around the painting is not limited to non-payment. \u00cd\u00f1igo Ram\u00edrez de Haro accused his brother of having &#8220;appropriated the painting, which belonged to the family, and did not pay taxes for it&#8221;. The painting was sold to pay off the older brother&#8217;s millionaire debt, but the agreed distribution of the money never materialized.
