The <strong data-start=\"968\" data-end=\"989\">Consell Consultiu<\/strong> has demanded the Govern to <strong data-start=\"1011\" data-end=\"1068\">reopen the process of hearing and public information<\/strong>, appreciating that the text was<strong data-start=\"1099\" data-end=\"1133\">&#8220;substantially modified&#8221;<\/strong> after the first public exhibition without offering the affected sectors the possibility of presenting new allegations. <strong data-start=\"1260\" data-end=\"1332\">The decision puts the brakes on the calendar that the Autonomous Executive was handling<\/strong> and returns the decree to a phase that was considered to have been overcome. <\/p>\n<ul>\n<li>\n<h4><a href=\"https:\/\/lavozdeibiza.com\/actualidad\/de-la-renovacion-de-licencias-al-tamano-de-los-coches-como-ha-cambiado-el-reglamento-que-regulara-el-taxi-en-ibiza\/?swcfpc=1\">From the renewal of licenses to the size of the cars: how the regulation that will regulate the cab in Ibiza has changed<\/a><\/h4>\n<\/li>\n<li>\n<h4><a href=\"https:\/\/lavozdeibiza.com\/en\/current-news\/economy-calls-for-a-major-reordering-of-the-regulations-that-will-define-the-future-of-cabs-and-uber-in-ibiza\/?swcfpc=1\">Economy calls for a major reordering of the regulations that will define the future of cabs and Uber in Ibiza<\/a><\/h4>\n<\/li>\n<\/ul>\n<p data-start=\"1395\" data-end=\"1966\">The reopening of the process is contained in a <strong data-start=\"1435\" data-end=\"1476\">resolution signed on December 19<\/strong> by the Councilor for Housing, Territory and Mobility, Jos\u00e9 Luis Mateo, and published on the portal of citizen participation of the Govern. The new period of public exposure is articulated <strong data-start=\"1663\" data-end=\"1686\">by way of urgency<\/strong> and will remain open <strong data-start=\"1709\" data-end=\"1732\">until January 2<\/strong>, with a period of <strong data-start=\"1750\" data-end=\"1772\">seven working days<\/strong> (counted from this Monday, December 22) to submit allegations, both online and in person. <strong data-start=\"1843\" data-end=\"1933\">The Govern itself states in the resolution that the step responds to a requirement of the Consultiu<\/strong>, not to a voluntary decision. <\/p>\n<ul>\n<li data-start=\"1395\" data-end=\"1966\">\n<h4><a href=\"https:\/\/lavozdeibiza.com\/en\/current-news\/cab-and-uber-regulations-move-forward-although-ib-dona-asks-to-polish-the-language-to-avoid-sexist-uses\/?swcfpc=1\">Cab and Uber regulations move forward, although IB Dona asks to polish the language to avoid &#8220;sexist uses&#8221;.<\/a><\/h4>\n<\/li>\n<\/ul>\n<h2 data-start=\"1968\" data-end=\"2021\">Why the Consultiu forces to repeat the procedure<\/h2>\n<p data-start=\"2022\" data-end=\"2651\">The origin of the decision is strictly legal. According to the resolution, the <strong data-start=\"2105\" data-end=\"2141\">president of the Consell Consultiu<\/strong> informed the president of the Govern on <strong data-start=\"2154\" data-end=\"2173\">December 18<\/strong> that, on examining the file, it had been detected that <strong data-start=\"2256\" data-end=\"2320\">after the hearing and participation procedures already carried out<\/strong>, <strong data-start=\"2349\" data-end=\"2406\">modifications<\/strong> were incorporated into the project <strong data-start=\"2349\" data-end=\"2406\">that the body considers &#8220;substantial&#8221;.<\/strong> In this context, the Consultiu concludes that it is <strong data-start=\"2459\" data-end=\"2508\">essential to repeat the public information<\/strong>, in application of its doctrine and the <strong data-start=\"2547\" data-end=\"2586\">jurisprudence of the Supreme Court<\/strong>, expressly citing <strong data-start=\"2612\" data-end=\"2648\">sentence 519\/2025, of May 6.<\/strong>  <\/p>\n<p data-start=\"2653\" data-end=\"3076\">The document does not list the specific changes that motivate the requirement, but makes it clear that it <strong data-start=\"2750\" data-end=\"2812\">is not enough to have informed a first version of the text<\/strong> if it is later significantly altered. Otherwise, the decree would be exposed to the <strong data-start=\"2908\" data-end=\"2929\">risk of nullity<\/strong> for violating the principles of participation and transparency. <strong data-start=\"2992\" data-end=\"3051\">This is the scenario that the Govern is now trying to avoid by<\/strong> reopening the procedure. <\/p>\n<ul>\n<li>\n<h4><a href=\"https:\/\/lavozdeibiza.com\/en\/current-news\/a-change-in-the-regulation-on-the-length-of-cars-baffles-ibiza-cab-drivers\/?swcfpc=1\">A change in the regulation on the length of cars baffles Ibiza cab drivers<\/a><\/h4>\n<\/li>\n<\/ul>\n<h2>A regulation with many twists and turns<\/h2>\n<p data-start=\"4395\" data-end=\"4997\">The cab and VTC regulation has not followed a linear path. It started at the beginning of <strong data-start=\"4479\" data-end=\"4487\">2025<\/strong> with <strong data-start=\"4492\" data-end=\"4524\">separate public consultations<\/strong> for cab and VTC, which were later <strong data-start=\"4564\" data-end=\"4595\">unified in a single text<\/strong>. After the first public exposure, the project has gone through <strong data-start=\"4659\" data-end=\"4688\">five drafts<\/strong>, incorporating changes derived from sectoral reports and technical opinions.  <\/p>\n<p>Precisely in that phase after the first public information <strong data-start=\"5083\" data-end=\"5123\">some of the most sensitive changes<\/strong> were introduced, which now forces to <strong data-start=\"5147\" data-end=\"5189\">go back a step in the procedure<\/strong>. The Government has opted for the urgent procedure in order not to further lengthen the process, but <strong data-start=\"5279\" data-end=\"5320\">the planned timetable has been altered<\/strong>. The autonomous Executive had not given dates for approving the regulation, but intended it to be ready at the beginning of 2026.  <\/p>\n<h2 data-start=\"5325\" data-end=\"5367\">A key precedent: the change on car size<\/h2>\n<p>The resolution of the Conseller\u00eda does not specify which are the &#8220;substantial changes&#8221; that trigger a new public exposure period.<\/p>\n<p>Among the <strong data-start=\"3155\" data-end=\"3188\">most discussed modifications<\/strong> of the regulation is the one related to <strong data-start=\"3229\" data-end=\"3260\">vehicle requirements<\/strong>, specifically the <strong data-start=\"3277\" data-end=\"3381\">elimination of the exception that allowed hybrid cars not to meet the minimum length requirement<\/strong>. In the <strong data-start=\"3390\" data-end=\"3425\">first versions of the draft<\/strong>, this exception existed and was <strong data-start=\"3455\" data-end=\"3498\">the one that was submitted for public information<\/strong>. However, <strong data-start=\"3513\" data-end=\"3541\">in later versions<\/strong> -from the third draft- the Government decided to <strong data-start=\"3591\" data-end=\"3605\">remove it<\/strong>, leaving the length reduction only for <strong data-start=\"3663\" data-end=\"3713\">100% electric<\/strong> vehicles <strong data-start=\"3663\" data-end=\"3713\">or other alternative energies<\/strong>, and <strong data-start=\"3717\" data-end=\"3764\">no longer opened a new period of allegations<\/strong>.  <\/p>\n<p data-start=\"3769\" data-end=\"4345\">This change generated <strong data-start=\"3787\" data-end=\"3822\">concern in the cab sector<\/strong>, especially among professionals who had acquired or planned to acquire hybrid vehicles under the initial text. The Govern defended that <strong data-start=\"3982\" data-end=\"4031\">the participation process was already closed<\/strong>, while some cab drivers questioned that <strong data-start=\"4087\" data-end=\"4168\">a relevant technical condition had been altered without the possibility of expressing their opinion<\/strong>. <\/p>\n<h2 data-start=\"4347\" data-end=\"4394\">The urgency and blocking of licenses<\/h2>\n<p data-start=\"5368\" data-end=\"5812\">The resolution justifies the urgent processing in a specific context: the validity of the <strong data-start=\"5456\" data-end=\"5553\">decree law that keeps new cab licenses and VTC authorizations suspended<\/strong> until the definitive regulation enters into force, at the latest, until <strong data-start=\"1000\" data-end=\"1025\">February 21, 2026<\/strong>, when the annual extension provided for in the decree law expires&#8230;.<\/p>\n<p>Now, the regulation will have to pass this new public exposure period before it returns to the  <strong data-start=\"6005\" data-end=\"6026\">Consell Consultiu<\/strong>  to issue its final opinion.<\/p>\n<p data-start=\"3175\" data-end=\"3455\">As this is a retroactive action limited to the public information process -and not an annulment of the procedure-, the decree must return to the Consell Consultiu for an opinion once the allegations have been analyzed, without it being necessary to repeat the sectorial reports already issued.<\/p>\n<p>Thus, once this  <strong data-start=\"6120\" data-end=\"6162\">second public information period<\/strong>the General Directorate of Mobility shall  <strong data-start=\"6205\" data-end=\"6233\">analyze the allegations<\/strong>If necessary, make further adjustments and  <strong data-start=\"6276\" data-end=\"6321\">to forward the project to the Consell Consultiu<\/strong>.
