The environmental organization bases its petition on the <strong data-start=\"1158\" data-end=\"1228\">protection of the environment and the right to a healthy environment<\/strong>, as stated in Article 45 of the Constitution and recognized by the UN as a <strong data-start=\"1305\" data-end=\"1333\">universal human right<\/strong>.<\/p>\n<ul>\n<li>\n<h4><a href=\"https:\/\/lavozdeibiza.com\/en\/current-news\/don-pepe-the-rulings-upholding-the-presumption-of-legality-of-block-a\/?swcfpc=1\">Don Pepe: the rulings upholding the presumption of legality of Block A<\/a><\/h4>\n<\/li>\n<\/ul>\n<p data-start=\"1492\" data-end=\"2077\">The group recalls that <strong data-start=\"1518\" data-end=\"1613\">Sant Josep de sa Talaia has been subjected to strong urban and tourist pressure for decades<\/strong>, a dynamic that, in their opinion, <strong data-start=\"1646\" data-end=\"1723\">contravenes the constitutional mandate to avoid land speculation<\/strong>. According to GEN-GOB, uncontrolled growth has generated <strong data-start=\"1784\" data-end=\"1832\">environmental, social and economic problems<\/strong>, such as the <strong data-start=\"1842\" data-end=\"1874\">depletion of aquifers<\/strong>, the <strong data-start=\"1879\" data-end=\"1922\">existence of thousands of empty homes<\/strong> and the <strong data-start=\"1928\" data-end=\"2001\">difficulty of access to decent housing for the resident population<\/strong>.<\/p>\n<h2 data-start=\"2079\" data-end=\"2133\">Criticisms of the Provisional Planning Rules<\/h2>\n<p data-start=\"2135\" data-end=\"2674\">In its allegations, the organization argues that the <strong data-start=\"2188\" data-end=\"2277\">NPPs initially approved by the Consell Insular do not reverse the existing situation<\/strong>, but rather <strong data-start=\"2288\" data-end=\"2311\">deepen<\/strong> it, by allowing <strong data-start=\"2329\" data-end=\"2411\">a municipality with serious water problems to double its population<\/strong>. GEN-GOB warns that <strong data-start=\"2440\" data-end=\"2489\">rural land remains outside the suspension<\/strong>, despite <strong data-start=\"2511\" data-end=\"2542\">intense urban pressure<\/strong> that <strong data-start=\"2547\" data-end=\"2591\">undermines its agricultural and environmental function<\/strong>.<\/p>\n<p data-start=\"2135\" data-end=\"2674\">The environmental document recognizes, according to the collective, the <strong data-start=\"2787\" data-end=\"2838\">structural limitation of water resources<\/strong> and the <strong data-start=\"2844\" data-end=\"2875\">pressure on aquifers<\/strong>, and is theoretically aligned with the principle of <strong data-start=\"2922\" data-end=\"2959\">not increasing water demand<\/strong>. Despite the fact that the planning foresees <strong data-start=\"3489\" data-end=\"3534\">a population increase of up to 50%<\/strong>, GEN-GOB stresses that <strong data-start=\"3559\" data-end=\"3606\">there is no analysis of the real capacity of the WWTPs<\/strong>, nor their operation in <strong data-start=\"3632\" data-end=\"3655\">seasonal peaks<\/strong>, nor are <strong data-start=\"3673\" data-end=\"3716\">investments or execution schedules<\/strong> for their expansion or improvement specified.<\/p>\n<p data-start=\"3892\" data-end=\"4308\">The reuse of treated water, demanded by GEN-GOB since 2004, is mentioned as an objective, but <strong data-start=\"4001\" data-end=\"4052\">without defined networks or implementation commitments<\/strong>, which leads the entity to conclude that <strong data-start=\"4095\" data-end=\"4183\">current infrastructures cannot even meet present needs<\/strong>, let alone new urban developments.<\/p>\n<h2 data-start=\"4310\" data-end=\"4359\">An &#8220;argumentative&#8221; containment of growth<\/h2>\n<p data-start=\"4361\" data-end=\"4848\">The environmental group considers that the claim of <strong data-start=\"4416\" data-end=\"4460\">no population increase is a fallacy<\/strong>, since the planning would allow for a significant real increase. This circumstance, they add, <strong data-start=\"4555\" data-end=\"4633\">disassociates growth from the real capacity of basic infrastructures<\/strong> such as water, sanitation or public facilities, invalidating any favorable environmental assessment based on <strong data-start=\"4746\" data-end=\"4779\">obsolete urban planning regulations<\/strong>.<\/p>\n<h2 data-start=\"4850\" data-end=\"4901\">Rustic land, the great forgotten of planning<\/h2>\n<p data-start=\"4903\" data-end=\"5324\">The NPPs <strong data-start=\"4911\" data-end=\"4963\">do not modify the buildability of rural land<\/strong>, a decision that GEN-GOB considers erroneous, as it <strong data-start=\"5019\" data-end=\"5073\">maintains and consolidates the diffuse urban pressure<\/strong>, especially associated with <strong data-start=\"5100\" data-end=\"5171\">single-family homes, swimming pools, gardens, wells and septic tanks<\/strong>, one of the main sources of <strong data-start=\"5205\" data-end=\"5238\">uncontrolled water consumption<\/strong> in the municipality.<\/p>\n<h2 data-start=\"5326\" data-end=\"5371\">Zero growth and tourism decline<\/h2>\n<p data-start=\"5373\" data-end=\"5916\">Given this scenario, GEN-GOB argues that the <strong data-start=\"5421\" data-end=\"5480\">suspension of planning should be total and permanent<\/strong> for residential and tourist uses, at least until <strong data-start=\"5541\" data-end=\"5629\">the aquifers<\/strong> are <strong data-start=\"5541\" data-end=\"5629\">recovered and the proper management of natural areas is guaranteed.<\/strong> The entity is committed to <strong data-start=\"5657\" data-end=\"5689\">zero urban growth<\/strong> and considers it <strong data-start=\"5702\" data-end=\"5763\">essential to apply measures to reduce tourism growth<\/strong>, as this sector <strong data-start=\"5794\" data-end=\"5841\">exceeds the carrying capacity of the
