The defense argues that Garc\u00eda did not commit any crime because he <strong data-start=\"864\" data-end=\"966\">did not participate in the decision to purchase nor did he maintain a contractual relationship with the company awarded the contract<\/strong>, according to the brief presented to the high court. <\/p>\n<ul>\n<li>\n<h4><a href=\"https:\/\/lavozdeibiza.com\/en\/current-news\/koldo-case-abalos-asks-armengol-to-testify-as-a-witness-in-the-supreme-court-for-the-purchase-of-masks\/?swcfpc=1\">Koldo case: \u00c1balos asks Armengol to testify as a witness in the Supreme Court for the purchase of masks<\/a><\/h4>\n<\/li>\n<\/ul>\n<p data-start=\"1118\" data-end=\"1735\">In her brief, to which <em>Europa Press<\/em> has had access, the former advisor&#8217;s lawyer stresses that <strong data-start=\"1207\" data-end=\"1340\">the company Soluciones de Gesti\u00f3n, considered the epicenter of the alleged scheme, acted without the direct intervention of her client<\/strong>, so that the alleged facts &#8220;do not constitute any crime&#8221;. <strong data-start=\"1415\" data-end=\"1545\">The defense insists that Garc\u00eda&#8217;s actions were limited to logistical tasks inherent to the exceptional context of the pandemic<\/strong>, marked by the scarcity of health material at international level.<\/p>\n<h3 data-start=\"1737\" data-end=\"1781\"><strong data-start=\"1741\" data-end=\"1781\">Request for key political witnesses<\/strong><\/h3>\n<p data-start=\"1783\" data-end=\"2341\"><strong data-start=\"1783\" data-end=\"2059\">Koldo Garc\u00eda has requested that the former Minister of Health and current president of the Generalitat of Catalonia, Salvador Illa; the Minister of the Interior, Fernando Grande-Marlaska, and the president of the Congress and former president of the Balearic Islands, Francina Armengol, testify as witnesses.<\/strong>  The defense considers that their testimonies are essential to clarify the functioning of the mechanisms for the purchase of health material during the health crisis.<\/p>\n<p data-start=\"2343\" data-end=\"2811\">Regarding Illa, the lawyer argues that <strong data-start=\"2385\" data-end=\"2442\">he was the highest health authority during the pandemic<\/strong> and that his statement would prove that <strong data-start=\"2489\" data-end=\"2567\">the material acquisition channels were not &#8220;assaulted&#8221; by a plot<\/strong>, but that they responded to criteria of urgent need and availability of stock in a collapsed market. <strong data-start=\"2675\" data-end=\"2811\">The defense wants Illa to confirm that Garc\u00eda&#8217;s intervention was an inter-ministerial collaboration and not an illicit interference.<\/strong><\/p>\n<p data-start=\"2813\" data-end=\"3261\">As for Grande-Marlaska, <strong data-start=\"2842\" data-end=\"2935\">the defense intends to dismantle the accusation of an alleged lobbying capacity of Garc\u00eda<\/strong>, since contracts of the Ministry of the Interior and processes in Correos are cited as examples of that influence. <strong data-start=\"3045\" data-end=\"3144\">Therefore, it considers it &#8220;imperative&#8221; that the minister explain the actual decision-making process<\/strong> in his department.<\/p>\n<p data-start=\"3263\" data-end=\"3602\">Regarding Armengol, Koldo Garc\u00eda requests her appearance <strong data-start=\"3318\" data-end=\"3447\">to disprove the existence of an alleged binding order or recommendation addressed to the Balearic autonomous administration<\/strong>. According to the defense, <strong data-start=\"3467\" data-end=\"3542\">only his testimony can prove that the Balearic Islands acted autonomously<\/strong>, based on technical reports and not on a network of favors. <\/p>\n<ul>\n<li>\n<h4><a href=\"https:\/\/lavozdeibiza.com\/en\/sin-categorizar\/supreme-court-rejects-abalos-and-koldo-garcia-to-be-tried-by-a-popular-jury\/?swcfpc=1\">Supreme Court rejects \u00c1balos and Koldo Garc\u00eda to be tried by a popular jury<\/a><\/h4>\n<\/li>\n<\/ul>\n<h3 data-start=\"3604\" data-end=\"3639\"><strong data-start=\"3608\" data-end=\"3639\">Criticism of Victor de Aldama<\/strong><\/h3>\n<p data-start=\"3641\" data-end=\"4158\">In the same document, <strong data-start=\"3662\" data-end=\"3739\">the defense of Koldo Garc\u00eda attacks the businessman V\u00edctor de Aldama<\/strong>, whom he describes as a &#8220;procedural platypus&#8221; and accuses of lying when he affirms that he agreed to share with \u00c1balos and Garc\u00eda approximately 50% of the commissions obtained. <strong data-start=\"3906\" data-end=\"4008\">The lawyer argues that these accusations are a speculative construction without evidentiary support<\/strong>, violating the presumption of innocence of the former advisor.<\/p>\n<p data-start=\"4160\" data-end=\"4366\">In addition, <strong data-start=\"4168\" data-end=\"4291\">the defense requests that Aldama&#8217;s interrogation be conducted first and under a regime similar to that of a witness<\/strong>, given the nature of his statements and his interest in the proceedings.<\/p>\n<h3 data-start=\"4368\" data-end=\"4408\"><strong data-start=\"4372\" data-end=\"4408\">Penalties requested and more witnesses<\/strong><\/h3>\n<p data-start=\"4410\" data-end=\"4839\"><strong data-start=\"4410\" data-end=\"4602\">The prosecution requests 24 years in prison for Jos\u00e9 Luis \u00c1balos, 19 and a half years for Koldo Garc\u00eda -both in pre-trial detention since November 27- and seven years for V\u00edctor de Aldama.<\/strong> For their part, the popular accusations, led by the PP, raise the request to <strong data-start=\"4686\" data-end=\"4740\">30 years in prison for the former minister and his former advisor<\/strong>.<\/p>\n<p data-start=\"4410\" data-end=\"4839\">The defense has also demanded the appearance of <strong data-start=\"4893\" data-end=\"4932\">other businessmen and public officials<\/strong>, including Juan Carlos Cueto, alleged commissioner of the case; Claudio Rivas, linked to the hydrocarbon scheme; the former president of Adif Isabel Pardo de Vera; the former general director of Roads Javier Herrero; the president of Correos, Pedro Saura; the former CEO of Air Europa Javier Hidalgo, and the former director of the CNI Paz Esteban, among others. <strong data-start=\"5278\" data-end=\"5367\">A list of witnesses that anticipates a trial of great political and judicial
