However, the <strong>beach kiosks<\/strong> are still standing in Formentera, as if nothing. Thus, the concessionaires of the beach kiosks of the <a href=\"https:\/\/lavozdeibiza.com\/en\/tag\/beach-kiosks\/?swcfpc=1\">contest under suspicion<\/a> are on the way to a <strong>new insubordination<\/strong> by not dismantling their structures this winter. The end, at this point, seems inevitable: <a href=\"https:\/\/lavozdeibiza.com\/en\/current-news\/a-legal-report-of-the-govern-proposes-to-expire-the-concession-of-the-beach-bars-of-formentera\/?swcfpc=1\">the loss of the concession as a result of essential breaches of the title. <\/a>    <\/p>\n<ul>\n<li data-start=\"862\" data-end=\"908\">\n<h5><a href=\"https:\/\/lavozdeibiza.com\/en\/current-news\/we-are-evaluating-it-the-beach-bars-have-not-decided-if-they-will-dismantle-this-winter\/?swcfpc=1\">&#8220;We are evaluating it&#8221;: the beach bars have not decided if they will dismantle this winter.<\/a><\/h5>\n<\/li>\n<li>\n<h5><a href=\"https:\/\/lavozdeibiza.com\/en\/current-news\/end-of-the-unity-in-the-insubordination-the-historic-beach-bar-of-formentera-that-renewed-the-concession-in-extremis-begins-to-dismantle\/?swcfpc=1\">End of the unity in the insubordination: the historic beach bar of Formentera that renewed the concession &#8216;in extremis&#8217; begins to dismantle.<\/a><\/h5>\n<\/li>\n<\/ul>\n<p data-start=\"910\" data-end=\"1212\">Just days before the legal deadline to have the facilities dismantled, everything seems to indicate that <strong data-start=\"910\" data-end=\"1075\">the beach bars are once again disobeying the regulations<\/strong>: this obligation is contemplated both in the General Coastal Regulations and in the concession title and the bidding specifications. Only one of the eight concessionaires (<a href=\"https:\/\/lavozdeibiza.com\/actualidad\/el-quiosco-bartolo-en-el-punto-de-mira-de-la-investigacion-del-derrumbe-que-causo-la-tragedia-en-formentera\/?swcfpc=1\"><strong>Bartolo<\/strong><\/a>) has started the dismantling, while <strong data-start=\"1152\" data-end=\"1211\">the other seven have not started any work<\/strong>.<\/p>\n<p data-start=\"1214\" data-end=\"1589\">According to La Voz de Ibiza <strong data-start=\"1240\" data-end=\"1287\"><a href=\"https:\/\/lavozdeibiza.com\/en\/\" target=\"_new\" rel=\"noopener\" data-start=\"1242\" data-end=\"1285\">La Voz de Ibiza<\/a><\/strong> after a visit to the affected beaches, <strong data-start=\"1328\" data-end=\"1359\">there are no signs of activity<\/strong> at the points where the kiosks are located, which <strong data-start=\"1407\" data-end=\"1473\">should be completely dismantled before January 15 and -at least- until February 15.<\/strong><\/p>\n<h2 data-start=\"1596\" data-end=\"1637\">No time<\/h2>\n<p data-start=\"1639\" data-end=\"2024\">Sources familiar with the sector warn that, <strong data-start=\"1686\" data-end=\"1749\">even if the removal work were to begin immediately<\/strong>, <strong data-start=\"1751\" data-end=\"1771\">there is no longer any margin<\/strong> for meeting the deadline.<\/p>\n<p data-start=\"1639\" data-end=\"2024\">The lack of action anticipates a <strong data-start=\"1827\" data-end=\"1847\">new insubordination<\/strong> as the one occurred last winter. Therefore, it immediately proposes to the &#8220;competent body to <strong>issue an agreement to initiate the procedure for the expiration of the concession CNC02\/21\/07\/0045,<\/strong> for breach of essential conditions related to the seasonal and removable nature of the facilities, as well as their correct location and extension on the maritime-terrestrial public domain&#8221;. <\/p>\n<h2>The test<\/h2>\n<p>These images were taken this Friday, where it can be seen that none of the seven chiringuitos have started the dismantling process.<\/p>\n<div id='gallery-1' class='gallery data-start=\"2266\" data-end=\"2311\">Sa Uni\u00f3&#8217;s change of position<\/h2>\n<p data-start=\"2313\" data-end=\"2604\">The overwhelming reports of the Govern have also left<strong> Sa Uni\u00f3<\/strong> on the ropes<strong>,<\/strong> which in recent weeks has had a change of position after the <a href=\"https:\/\/lavozdeibiza.com\/en\/current-news\/the-report-that-reveals-the-complicity-of-the-government-of-sa-unio-in-the-consell-de-formentera-with-the-concessionaires-of-the-beach-bars\/?swcfpc=1\">complicities with the chiringuiteros were revealed <\/a><strong>.<\/strong>  <\/p>\n<p data-start=\"2313\" data-end=\"2604\">After trying to avoid the obligation of dismantling and <a href=\"https:\/\/lavozdeibiza.com\/actualidad\/el-regalo-del-consell-de-formentera-aplica-una-multa-ridicula-a-los-chiringuitos-por-no-desmontar\/\">applying a derisory fine<\/a> to the concessionaires for non-compliance during the last winter -an<a href=\"https:\/\/lavozdeibiza.com\/actualidad\/sa-unio-ejecuta-el-plan-de-los-chiringuitos-los-adjudicatarios-pidieron-la-multa-minima-y-no-desmontar\/\">economic amountthat had even been proposed by the sanctioned ones-<\/a> the <strong data-start=\"2322\" data-end=\"2355\">Consell Insular de Formentera<\/strong> has hardened its discourse and pointed out that &#8220;compliance is not optional&#8221;.<\/p>\n<p data-start=\"2606\" data-end=\"2961\">&#8220;<strong data-start=\"2606\" data-end=\"2710\">Compliance with the specifications is not optional and repeated violations have consequences,&#8221;<\/strong> stressed the first vice president and councilor of the area, <strong data-start=\"2728\" data-end=\"2795\">Ver\u00f3nica Castell\u00f3<\/strong>, who <strong data-start=\"2803\" data-end=\"2870\">is confident that the concessionaires act in accordance with the law<\/strong>, although she admits the difficulty of the schedule: <strong data-start=\"2916\" data-end=\"2960\">&#8220;For a month they must be dismantled.<\/strong><\/p>\n<p data-start=\"2606\" data-end=\"2961\">In addition, the Consell has confirmed that the awarded companies have already been formally notified and that the requirement is <strong data-start=\"2538\" data-end=\"2590\">&#8220;independent of the sanctioning proceedings&#8221;, which<\/strong> are already underway <strong data-start=\"2538\" data-end=\"2590\">.<\/strong><\/p>\n<h2 data-start=\"2968\" data-end=\"3023\">Repeated history<\/h2>\n<p data-start=\"3025\" data-end=\"3289\">This situation <strong data-start=\"3040\" data-end=\"3055\">is not new<\/strong>. In the previous winter, <strong data-start=\"3082\" data-end=\"3133\">none of the eight beach bars was dismantled<\/strong>, despite the fact that the specifications and the <strong data-start=\"3165\" data-end=\"3186\">Ministerial Order<\/strong> that regulates the concessions <strong data-start=\"3214\" data-end=\"3288\">expressly requires the removal during the first quarter for a month. <\/strong>Meanwhile, the Consell Insular had established the date between January 15 and February 15. <\/p>\n<ul>\n<li>\n<h5><a href=\"https:\/\/lavozdeibiza.com\/en\/current-news\/demolishing-report-formenteras-beach-bars-on-the-ropes\/?swcfpc=1\">Demolishing report: Formentera&#8217;s beach bars on the ropes<\/a><\/h5>\n<\/li>\n<li>\n<h5><a href=\"https:\/\/lavozdeibiza.com\/en\/current-news\/a-legal-report-of-the-govern-proposes-to-expire-the-concession-of-the-beach-bars-of-formentera\/?swcfpc=1\">A legal report of the Govern proposes to expire the concession of the beach bars of Formentera.<\/a><\/h5>\n<\/li>\n<\/ul>\n<p data-start=\"3291\" data-end=\"3704\">At the time, the <strong data-start=\"3304\" data-end=\"3358\">infringement resulted in fines of only 1,500 euros<\/strong> per kiosk, a derisory amount compared to the cost of dismantling and reassembling the structures.<\/p>\n<p data-start=\"3291\" data-end=\"3704\">As <strong><a href=\"https:\/\/lavozdeibiza.com\/en\/\" target=\"_new\" rel=\"noopener\" data-start=\"3484\" data-end=\"3527\">La Voz de Ibiza<\/a><\/strong> reported <strong>,<\/strong> the situation caused the complaint of former concessionaires and the <strong data-start=\"3595\" data-end=\"3602\">Government<\/strong>, which led to the opening of an <strong data-start=\"3637\" data-end=\"3663\">informative dossier<\/strong> by the <strong data-start=\"3680\" data-end=\"3703\">Conselleria del Mar.<\/strong><\/p>\n<h2 data-start=\"4476\" data-end=\"4529\">Non-detachable structures: the crux of the problem<\/h2>\n<p data-start=\"4531\" data-end=\"4830\">Part of the problem lies in the fact that many of the kiosks <strong data-start=\"4586\" data-end=\"4622\">are not technically dismountable<\/strong>, something that had also been reported by this newspaper.<\/p>\n<p data-start=\"4531\" data-end=\"4830\">In addition, the Govern&#8217;s technical report indicates that <strong data-start=\"4684\" data-end=\"4762\">at least three beach bars could not be dismantled without breaching regulations<\/strong>, and that two others could only do so under specific conditions.<\/p>\n<ul>\n<li>\n<h5><a href=\"https:\/\/lavozdeibiza.com\/actualidad\/las-siete-irregularidades-graves-por-la-que-piden-la-nulidad-de-las-concesiones-de-los-chiringuitos-de-formentera\/?swcfpc=1\">The seven serious irregularities for which they ask for the nullity of the concessions of the beach bars of Formentera<\/a><\/h5>\n<\/li>\n<\/ul>\n<p data-start=\"4832\" data-end=\"5160\">The kiosks of <strong data-start=\"4847\" data-end=\"4892\">Es Pujols (lot 24), Es Migjorn (lot 43)<\/strong> and <strong data-start=\"4895\" data-end=\"4918\">Cala Saona (lot 3)<\/strong> are listed as <strong data-start=\"4932\" data-end=\"4951\">not removable<\/strong>, while <strong data-start=\"4966\" data-end=\"4987\">Arenals (lot 35)<\/strong> and <strong data-start=\"4990\" data-end=\"5014\">Es Copinar (lot 27)<\/strong> would be <strong data-start=\"5025\" data-end=\"5046\">&#8220;with conditions&#8221;<\/strong>. Only <strong data-start=\"5053\" data-end=\"5128\">three structures (Arenals lot 38, Es Mar\u00ed lot 50 and Es Pujols lot 19)<\/strong> are apparently dismountable. <\/p>\n<h2><strong>Three serious misdemeanors<\/strong><\/h2>\n<p><span style=\"font-weight: 400;\">The bidding documents also contemplate that, in the event of three serious offenses or their equivalents accumulated by licensees, the Consell has the power to withdraw the concession.  <\/span><\/p>\n<p><span style=\"font-weight: 400;\">In case this new insubordination in the making materializes, several beach bars will be in this situation. As reported this week by the Consell Insular de Formentera, the following have been established   <\/span>37 serious violations and 5 very serious violations (of the 72 sanctions imposed).<\/p>\n<ul>\n<li>\n<h5><a href=\"https:\/\/lavozdeibiza.com\/actualidad\/concurso-bajo-sospecha-antiguos-concesionarios-de-chiringuitos-advierten-al-consell-de-formentera-con-acciones-legales-inmediatas\/?swcfpc=1\">Competition under suspicion: former beach bar concessionaires warn the Consell de Formentera of immediate legal action<\/a><\/h5>\n<\/li>\n<\/ul>\n<p>This does not include last season&#8217;s and the non-compliance due to the failure to dismantle the previous season.<\/p>\n<p>Thus, at least 80 violations have been recorded in just two years, at an average of 10 violations per beach bar.<\/p>\n<p>The Consell has responded that &#8220;these procedures are first notified of the sanctions and there is a period of allegations.
