Following the agents&#8217; complaint, the <strong>Ibiza Town Hall<\/strong> has opened a <strong>file<\/strong> for non-compliance with the urban planning license.   <\/span><\/p>\n<ul>\n<li>\n<h5><a href=\"https:\/\/lavozdeibiza.com\/actualidad\/ses-feixes-busca-soluciones-para-frenar-las-infracciones-mejorar-el-saneamiento-y-recuperar-sus-parcelas-abandonadas\/?swcfpc=1\">Ses Feixes seeks solutions to curb infractions, improve sanitation and recover abandoned plots of land<\/a><\/h5>\n<\/li>\n<li>\n<h5><a href=\"https:\/\/lavozdeibiza.com\/actualidad\/nuevo-impulso-para-proteger-ses-feixes-el-pulmon-verde-de-talamanca\/?swcfpc=1\">Ibiza unites to protect ses Feixes, the green lung of Talamanca<\/a><\/h5>\n<\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">The controversial work is being carried out on a plot located in <strong>ses Feixes<\/strong> street <strong>No. 34<\/strong> and has two licenses: one for the<strong>rehabilitation of a single-family house and outbuildings<\/strong> by the City Council of Ibiza and another for the<strong> recovery of cultivation<\/strong> of the Ministry of Environment of the Balearic Government.  <\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to the sign indicating the type of work, placed as required by the regulations on the facade of the site, the work began on September 1 last year, with a term of<strong> 36 months<\/strong>, whose promoters are <strong>Francisco \u00c1lvarez Mar\u00edn and Jos\u00e9 Luis Rodr\u00edguez Vicente <\/strong>.  <\/span><\/p>\n<figure id=\"attachment_148967\" aria-describedby=\"caption-attachment-148967\" style=\"width: 1280px\" class=\"wp-caption alignnone\"><a href=\"https:\/\/lavozdeibiza.com\/actualidad\/urbanismo-en-ibiza-vertidos-de-tierra-y-obras-ilegales-en-ses-feixes-en-el-punto-de-mira-del-seprona\/attachment\/ses-feixes4\/\" rel=\"attachment wp-att-148966\"><img decoding=\"async\" class=\"size-full wp-image-148966\" src=\"https:\/\/lavozdeibiza.com\/wp-content\/uploads\/2026\/01\/ses-feixes4.jpeg\" alt=\"\" width=\"1280\" height=\"960\" srcset=\"https:\/\/lavozdeibiza.com\/wp-content\/uploads\/2026\/01\/ses-feixes4.jpeg 1280w, https:\/\/lavozdeibiza.com\/wp-content\/uploads\/2026\/01\/ses-feixes4-300x225.jpeg 300w, https:\/\/lavozdeibiza.com\/wp-content\/uploads\/2026\/01\/ses-feixes4-768x576.jpeg 768w\" sizes=\"(max-width: 1280px) 100vw, 1280px\" \/><\/a><figcaption id=\"caption-attachment-148967\" class=\"wp-caption-text\">The work under the watchful eye of the Guardia Civil in the protected area of ses Feixes.<\/figcaption><\/figure>\n<h2><strong>Two open fronts<\/strong><\/h2>\n<p><span style=\"font-weight: 400;\">According to what has been learned <strong><a href=\"https:\/\/lavozdeibiza.com\/en\/\">La Voz de Ibiza<\/a><\/strong>the owners have two open fronts against them: on the one hand, a complaint for urban infraction for having exceeded the conditions established in the municipal authorization; and, on the other hand, a complaint from the Seprona for the earthworks and dumping.  <\/span><\/p>\n<p><span style=\"font-weight: 400;\">The City Council has confirmed to this media that &#8220;<strong>there is an open file<\/strong>&#8221; for non-compliance with the license granted for exceeding the established volumes.  <\/span><\/p>\n<p>The Seprona is currently investigating the case which will determine the amount of the penalties.<\/p>\n<p><span style=\"font-weight: 400;\">For this reason, they have requested information from the City Council on the legality of the constructions. Currently, two of them continue with the project, keeping alive the spirit with which it was born&#8221;. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">&#8220;Because of the heritage value of the environment, the intervention has required special sensitivity. The involvement of the archaeologist Mar\u00eda Jos\u00e9 Escandell &#8211; known to everyone as Pepa &#8211; has been fundamental, and her supervision has guaranteed respect for the historical and cultural values of the site,&#8221; they say.<\/span><\/p>\n<figure id=\"attachment_148980\" aria-describedby=\"caption-attachment-148980\" style=\"width: 1214px\" class=\"wp-caption alignnone\"><a style=\"font-weight: 400;\">In ses Feixes, the <a href=\"https:\/\/santaeulariadesriu.com\/images\/02_documentacion\/urbanismo\/planes_especiales\/09_Normativa_SE.pdf\">Special Plan for the Conservation, Protection and Recovery of Prat de ses Monges<\/a> establishes a particularly restrictive regulation on the<strong> dumping of soil<\/strong>, to the point that this type of action is not allowed as an ordinary practice within its scope.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The regulations consider that the dumping of earth, debris or any material that is not part of the traditional system of this area <strong>directly alters the topography, the water regime and the ethnological and environmental values<\/strong> that the plan aims to preserve.  <\/span><\/p>\n<p><span style=\"font-weight: 400;\">For that reason, landfills and earth contributions <strong>are prohibited when they imply a modification of the natural elevations of the land or affect characteristic elements of ses Feixes<\/strong>, such as canals, irrigation ditches, dry stone walls or the historical parcelization of the wetland.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The plan classifies these activities as incompatible with the conservation of the area, which means that they cannot be authorized by means of ordinary urban planning licenses or regularized a posteriori.  <\/span><\/p>\n<p><span style=\"font-weight: 400;\">In practice, the dumping of soil for purposes such as leveling plots, &#8220;improving&#8221; the land or clearing it, even when it is topsoil, is not allowed.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Only <strong>exceptionally could land contributions<\/strong> linked to environmental restoration or heritage recovery projects expressly approved by the competent administration <strong>be authorized<\/strong>.  <\/span><\/p>\n<p><span style=\"font-weight: 400;\">In these cases, the actions must be fully justified, use compatible materials, not alter the existing elevations or the traditional hydraulic system and have express authorization, without the possibility of administrative silence.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Failure to comply with these determinations can have significant consequences. <strong>The dumping of soil in ses Feixes is usually classified as urban and environmental infractions<\/strong>, with the corresponding opening of sanctioning proceedings and the obligation to restore the land to its original state, as well as possible additional responsibilities if there is an affection to the ethnological heritage or the public hydraulic domain.<\/span><\/p>\n<h2><strong>More protection for ses Feixes?<\/strong><\/h2>\n<p><span style=\"font-weight: 400;\">Last October, the Consell de Ibiza, together with the town councils of Vila and Santa Eul\u00e0ria, and environmental organizations, agreed to promote the incorporation of the ses Feixes de Talamanca wetland into the Natura 2000 network. <a href=\"https:\/\/lavozdeibiza.com\/actualidad\/ses-feixes-busca-soluciones-para-frenar-las-infracciones-mejorar-el-saneamiento-y-recuperar-sus-parcelas-abandonadas\/?swcfpc=1\"><strong>incorporation of the wetland of ses Feixes de Talamanca to the Natura 2000 Network.<\/strong><\/a>.  <\/span><\/p>\n<p><span style=\"font-weight: 400;\">The agreement was reached within the framework of the fourth Mesa de Participaci\u00f3n for the recovery of this area, a body that brings together public administrations, social groups and environmental organizations.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Precisely, during that meeting the need to advance in the restoration of ses Feixes was raised as a key tool to reduce the risk of flooding in the area and to address historical problems related to the management of sewage and <strong>urban infractions accumulated in the environment<\/strong>.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">As reported by the insular institution at the time, the initiative aims to ensure the effective protection and ecological restoration of ses Feixes, considered an ecosystem of high environmental value for the functions it performs.  <\/span><\/p>\n<p><span style=\"font-weight: 400;\">The proposal received the unanimous support of the participants after the presentation of a report prepared jointly by the Water Alliance and the City Council of Santa Eul\u00e0ria, which highlights the ecological values of the wetland, both for the diversity of wildlife that houses the relevance of their habitats.<\/span><\/p>\n<figure id=\"attachment_148972\" aria-describedby=\"caption-attachment-148972\" style=\"width: 1280px\" class=\"wp-caption alignnone\"><a the Natura 2000 Network would also allow access to protection instruments and European funding to advance in its recovery, in line with EU directives that require member states to restore degraded ecosystems.  <\/span><\/p>\n<p><span style=\"font-weight: 400;\">In this context, the Participation Committee agreed to formally transfer the request to the Balearic Government, which is the competent administration to process and officially declare this figure of protection.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">During the meeting, the conservationist organizations also raised the convenience of extending the scope of protection to the marine area of Talamanca Bay, with the objective of applying integrated conservation measures that take into account both the terrestrial and
