In the resolution of the Board of Directors of the APB, to which <strong>La Voz de Ibiza<\/strong> had access, it is recorded that it has been unanimously agreed the &#8220;proposal of communication to the Public Prosecutor of the actions related to the refusal of MDF (Marina de Formentera) to deliver the facilities of the administrative concession for the <em>Management of mooring places in the inner west dock of the port of La Savina<\/em>&#8220;. Therefore, the Public Prosecutor&#8217;s Office has been informed &#8220;of the facts referred to in the proposal, giving<strong> transfer to the State Attorney for their appearance and the instructor of the sanctioning procedure&#8221;.<\/strong><\/p>\n<h2>Squatters<\/h2>\n<p>A day before the end of the concession, on May 27, 2022, Marina de Formentera announced that it<strong> would not abandon the port facilities in the western dock pending the resolution of the contentious appeal<\/strong> it had filed after the APB denied it a 35-year extension. In a press conference, the company&#8217;s representative, <a href=\"https:\/\/lavozdeibiza.com\/?s=angel+bustos&amp;lang=es\"><strong>\u00c1ngel Bustos<\/strong><\/a>accompanied by the lawyer Francisco Javier Jim\u00e9nez Cisnero <a href=\"https:\/\/lavozdeibiza.com\/?s=Francisco+Javier+Jim%C3%A9nez+Cisneros+de+Cid&amp;lang=es\"><strong>Francisco Javier Jim\u00e9nez Cisneros de Cid<\/strong><\/a> announced this decision and accused the APB of acting in a &#8220;<strong>discriminatory<\/strong>&#8221; manner by not granting an extension.<\/p>\n<p><a href=\"https:\/\/lavozdeibiza.com\/actualidad\/2024\/05\/08\/negligencia-del-consell-de-formentera-caduca-el-plan-especial-de-la-savina-tras-ser-incapaz-de-aprobarlo-en-plazo-y-debera-reiniciar-su-tramitacion\/attachment\/la-savina\/\" rel=\"attachment wp-att-27131\"><img decoding=\"async\" class=\"size-full wp-image-27131\" title=\"La Savina\" src=\"https:\/\/lavozdeibiza.com\/wp-content\/uploads\/2024\/05\/La-Savina.jpg\" alt=\"La Savina\" width=\"750\" height=\"500\" srcset=\"https:\/\/lavozdeibiza.com\/wp-content\/uploads\/2024\/05\/La-Savina.jpg 750w, https:\/\/lavozdeibiza.com\/wp-content\/uploads\/2024\/05\/La-Savina-300x200.jpg 300w\" sizes=\"(max-width: 750px) 100vw, 750px\" \/><\/a><\/p>\n<p><strong>Bustos<\/strong> questioned the APB of conducting a <strong>&#8220;public auction&#8221;<\/strong> that has not taken into account the economic and financial report of the bidders. For this reason, they had gone to the High Court of Justice of the Balearic Islands to reverse the decision of the APB of February 23, 2022 in which the extension of the concession was denied. With this, Marina de Formentera became a <strong>squatter for the entire summer season,<\/strong> the most profitable and obtaining a significant lucrative benefit, something that had never occurred in the history of the APB. For this reason, the president of the organization at the time, <strong>Francesc Antich<\/strong>, had to file an <strong>eviction laws<\/strong> uit with the <strong>Superior Court of Justice of the Balearic Islands (TSJB)<\/strong>, since Marina Formentera did not have the necessary authorization to do so. This made it impossible for approximately four and a half months for <strong>Port Med Formentera<\/strong>, owned by the group of <a href=\"https:\/\/lavozdeibiza.com\/?s=Nicol%C3%A1s+Mayol&amp;lang=es\"><strong>Nicol\u00e1s Mayol<\/strong><\/a>to take possession of the concession for the management of berths and premises in the west inner dock, which it had won in a public tender for temporary occupation for a maximum of three years with an offer of 1.5 million euros, which tripled the starting fee of the tender. Only on October 4, 2022, Marina de Formentera announced that it was abandoning <em>motu proprio<\/em> in the face of the imminent forced eviction of the APB.
