This registry aims to ensure transparency and legality in the sector, adapting Spanish regulations to <strong>Regulation (EU) 2024\/1028<\/strong>. <\/p>\n<ul>\n<li>\n<h4><a href=\"https:\/\/lavozdeibiza.com\/actualidad\/2024\/12\/24\/el-boe-publica-el-decreto-que-aprueba-el-nuevo-registro-unico-de-alquileres-de-corta-duracion-como-funciona-y-que-dice-airbnb\/?swcfpc=1\">New single registry for short-term rentals: how it works and what Airbnb says<\/a><\/h4>\n<\/li>\n<\/ul>\n<p>The following are the <strong>obligations of tenants<\/strong> and the <strong>step-by-step instructions for registering in the Unified Registry.<\/strong><\/p>\n<h2><strong>What are the requirements for tenants?<\/strong><\/h2>\n<p>According to <strong>Article 5<\/strong> of the Royal Decree, lessors (individuals or legal entities) are obliged to: <\/p>\n<ol>\n<li><strong>Obtaining the Registration Number<\/strong>: Before offering a property for short-term rental, a unique registration number must be applied for at the <strong>Land Registry or the Registry of Movable Property.<\/strong><\/li>\n<li><strong>Provide the required information<\/strong>: It is necessary to provide complete information about the property, such as its address, cadastral reference, maximum capacity, and type of use (tourist or not).<\/li>\n<li><strong>Respond to requests from the authorities<\/strong>: Lessees must respond to requests for information from the competent authorities regarding their units.<\/li>\n<li><strong>Update the information<\/strong>: Any change in the characteristics of the property, such as its use or capacity, must be communicated to the registry.<\/li>\n<li><strong>Communicate the Registration Number to the rental platforms<\/strong>: To advertise the property on platforms such as Airbnb, it will be mandatory to include the registration number in the ad.<\/li>\n<\/ol>\n<h2>How to register in the Single Registry of Tenants?<\/h2>\n<p>The <strong>Single Registry of Leases<\/strong> will be the only valid procedure in Spain for the registration of properties intended for short-term rental, in accordance with <strong>Regulation (EU) 2024\/1028<\/strong>. This registry will be processed through the <strong>Land Registry<\/strong> or the <strong>Registry of Movable Property<\/strong>, following the provisions of this regulation and, in a supplementary manner, by the mortgage legislation. <\/p>\n<p><strong>Initiation of the procedure<\/strong><\/p>\n<p>Registration must be initiated by the interested lessor. The application may be submitted: <\/p>\n<ul>\n<li><strong>Electronically:<\/strong> Through the electronic headquarters of the <strong>Association of Property and Mercantile Registrars of Spain<\/strong>, using:\n<ul>\n<li>Electronic certificates.<\/li>\n<li>Cl@ve system.<\/li>\n<li>Non-cryptographic signatures (OTP codes or other pre-arranged key systems).<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li><strong>In person: At<\/strong> the offices of the Land Registry or the corresponding Registry of Movable Property, presenting the application on paper.<\/li>\n<\/ul>\n<p><strong>2. Documentation required for the application<\/strong><\/p>\n<p>The application must include specific information on:<\/p>\n<ul>\n<li><strong>a) The leased unit:<\/strong>\n<ol>\n<li>Address, <strong>Unique Registry Code (CRU)<\/strong> and cadastral reference.<\/li>\n<li>Type of unit (whole farm, room, boat, etc.).<\/li>\n<li>Whether it is a primary residence, secondary residence or for other purposes.<\/li>\n<li>Maximum capacity (number of people that can be accommodated).<\/li>\n<li>Documentation of the enabling title (authorizations, licenses, visas, etc.) or responsible declarations if regional or local regulations apply.<\/li>\n<li>Lease category (may be simultaneous):\n<ul>\n<li><strong>Short-term non-tourist:<\/strong> Rental for non-tourist purposes.<\/li>\n<li><strong>Short-term tourism:<\/strong> Includes rentals for tourism purposes.<\/li>\n<li><strong>Vessels:<\/strong> For floating accommodation not excluded by European regulation.<\/li>\n<\/ul>\n<\/li>\n<li>Declaration of compliance with Article 4.2.b (valid enabling title).<\/li>\n<\/ol>\n<\/li>\n<\/ul>\n<ul>\n<li><strong>b) Individuals as lessors:<\/strong>\n<ol>\n<li>First and last name.<\/li>\n<li>Tax Identification Number (NIF).<\/li>\n<li>Address.<\/li>\n<li>Contact telephone number.<\/li>\n<li>E-mail address.<\/li>\n<\/ol>\n<\/li>\n<\/ul>\n<ul>\n<li><strong>c) Legal entities as lessors:<\/strong>\n<ol>\n<li>Corporate name.<\/li>\n<li>Tax Identification Number (NIF).<\/li>\n<li>Data of the legal representative.<\/li>\n<li>Registered office.<\/li>\n<li>Representative&#8217;s contact telephone number.<\/li>\n<li>E-mail address.<\/li>\n<\/ol>\n<\/li>\n<\/ul>\n<p><strong>3.
