This regulation adapts national legislation to <strong>Regulation (EU) 2024\/1028<\/strong>, with measures that promise to bring greater transparency, control and legal certainty to the sector. <\/p>\n<ul>\n<li>\n<h4><a href=\"https:\/\/lavozdeibiza.com\/actualidad\/2024\/12\/12\/el-municipio-de-ibiza-con-los-alquileres-mas-caros-de-espana\/?swcfpc=1\">The municipality of Ibiza with the most expensive rents in Spain<\/a><\/h4>\n<\/li>\n<\/ul>\n<p>According to the decree, &#8220;the expansive growth of short-term vacation rentals <strong>is removing homes from the market and causing an increase in prices<\/strong>, and may have a <strong>negative impact<\/strong> on the habitability of urban and tourist centers&#8221;. In addition, it points out that &#8220;the lack of information related to the leases that are being constituted has led to the foreseeable existence of <strong>a relevant percentage of leases in a situation of fraud of law.&#8221;<\/strong> In this context, the decree seeks to regularize and control the market with instruments such as the <strong>Single Registry of Leases<\/strong> and the <strong>Digital Single Window for Leases<\/strong>.<\/p>\n<h2><strong>Single Registry and One-Stop Shop: the pillars of the decree<\/strong><\/h2>\n<p>The Royal Decree introduces two key tools to regulate the market:<\/p>\n<ol>\n<li><strong>Single Registry of Leases<\/strong>:\n<ul>\n<li>Each rental unit must be registered and have a unique number, without which it cannot be offered on digital platforms.<\/li>\n<li>This registration will be managed through the Land Registry or the Registry of Movable Property.<\/li>\n<li><em>&#8220;Through the registration procedure, a unique registration number will be obtained [&#8230;] without which its offer cannot be carried out on online short term rental platforms.&#8221;<\/em><\/li>\n<\/ul>\n<\/li>\n<li><strong>One-Stop Digital Leasing Window<\/strong>:\n<ul>\n<li>Platform managed by the Ministry of Housing, in charge of coordinating data transmission between platforms and authorities.<\/li>\n<li>It will allow consultation and verification of lease information, in addition to facilitating the issuance of administrative resolutions.<\/li>\n<li><em>&#8220;The Digital One-Stop-Shop [&#8230;] will enable the electronic transmission of data between online short-term rental platforms and the competent authorities.&#8221;<\/em><\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<figure id=\"attachment_78042\" aria-describedby=\"caption-attachment-78042\" style=\"width: 1200px\" class=\"wp-caption alignnone\"><img decoding=\"async\" class=\"wp-image-78041 size-full\" title=\"Isabel Rodr\u00edguez, Minister of Housing and Urban Agenda (Europa Press).\" src=\"https:\/\/lavozdeibiza.com\/wp-content\/uploads\/2024\/12\/1200x655_EuropaPress_6237534_ministra_vivienda_agenda_urbana_isabel_rodriguez_rueda_prensa_reunion_sede.jpg\" alt=\"Isabel Rodr\u00edguez, Minister of Housing and Urban Agenda (Europa Press).\" width=\"1200\" height=\"655\" srcset=\"https:\/\/lavozdeibiza.com\/wp-content\/uploads\/2024\/12\/1200x655_EuropaPress_6237534_ministra_vivienda_agenda_urbana_isabel_rodriguez_rueda_prensa_reunion_sede.jpg 1200w, https:\/\/lavozdeibiza.com\/wp-content\/uploads\/2024\/12\/1200x655_EuropaPress_6237534_ministra_vivienda_agenda_urbana_isabel_rodriguez_rueda_prensa_reunion_sede-300x164.jpg 300w, https:\/\/lavozdeibiza.com\/wp-content\/uploads\/2024\/12\/1200x655_EuropaPress_6237534_ministra_vivienda_agenda_urbana_isabel_rodriguez_rueda_prensa_reunion_sede-768x419.jpg 768w\" sizes=\"(max-width: 1200px) 100vw, 1200px\" \/><figcaption id=\"caption-attachment-78042\" class=\"wp-caption-text\">Isabel Rodr\u00edguez, Minister of Housing and Urban Agenda (Europa Press).<\/figcaption><\/figure>\n<h2><strong>Obligations for platforms such as Airbnb<\/strong><\/h2>\n<p>The decree also imposes new responsibilities on short term rental platforms:<\/p>\n<ul>\n<li><strong>Validate the registration number<\/strong> of each unit before publication.<\/li>\n<li><strong>Perform periodic and random checks<\/strong> to ensure the veracity of the data.<\/li>\n<li><strong>Transmit monthly<\/strong> activity data to the One-Stop Shop, including address, ad URL and registration number.<\/li>\n<li><strong>Eliminate irregular advertisements within 48 hours<\/strong> after receiving administrative notifications.<\/li>\n<\/ul>\n<h2><strong>Impact on hosts and local communities<\/strong><\/h2>\n<p>The Royal Decree poses significant challenges for both hosts and local communities:<\/p>\n<ul>\n<li><strong>For hosts<\/strong>: The accumulation of registrations could disincentivize small landlords, who already face other administrative barriers.<\/li>\n<li><strong>For the platforms<\/strong>: The new obligations imply higher operational costs, from verification systems to data transmissions.<\/li>\n<li><strong>In the market<\/strong>: Although regulation could reduce irregular supply, it could also limit the flexibility of this business model.<\/li>\n<\/ul>\n<h2>Airbnb&#8217;s response: &#8220;It falls short&#8221;.<\/h2>\n<p>Airbnb has taken a critical stance on <strong>Royal Decree 1312\/2024. <\/strong>The company claims that this &#8220;falls short&#8221; of its purpose of harmonizing registration obligations for hosts and ensuring greater transparency in the sector. In a statement issued yesterday, Airbnb acknowledged the efforts of the <strong>Ministry of Housing<\/strong> during the public consultation process to address concerns raised by the platform, especially in relation to the implementation of <strong>Regulation (EU) 2024\/1028.<\/strong> However, it believes that the regulation does not establish a &#8220;single point of entry&#8221; for the registration of hosts, as proposed by the European framework. Instead, the decree encourages an <strong>&#8220;accumulation of different registers&#8221; at the national, autonomic and municipal levels<\/strong>, which, according to Airbnb, <strong>will complicate the administrative tasks of hosts<\/strong> who want to share their homes on short-term rental platforms. Despite this criticism, Airbnb has indicated that it will continue to collaborate with the government in the technical development of the decree.
