In this sense, it determines that &#8220;this area must be left permanently open for public pedestrian passage and for surveillance and rescue vehicles, except in specially protected areas&#8221;.<\/p>\n<figure id=\"attachment_82150\" aria-describedby=\"caption-attachment-82150\" style=\"width: 792px\" class=\"wp-caption alignnone\"><a href=\"https:\/\/lavozdeibiza.com\/actualidad\/2025\/01\/21\/nueva-irregularidad-del-concurso-bajo-sospecha-de-formentera-chiringuitos-instalados-en-zonas-inundables\/attachment\/ley-de-costas\/\" rel=\"attachment wp-att-82149\"><img decoding=\"async\" class=\"size-full wp-image-82149\" title=\"coastal law\" src=\"https:\/\/lavozdeibiza.com\/wp-content\/uploads\/2025\/01\/ley-de-costas.jpg\" alt=\"coastal law\" width=\"792\" height=\"457\" srcset=\"https:\/\/lavozdeibiza.com\/wp-content\/uploads\/2025\/01\/ley-de-costas.jpg 792w, https:\/\/lavozdeibiza.com\/wp-content\/uploads\/2025\/01\/ley-de-costas-300x173.jpg 300w, https:\/\/lavozdeibiza.com\/wp-content\/uploads\/2025\/01\/ley-de-costas-768x443.jpg 768w\" sizes=\"(max-width: 792px) 100vw, 792px\" \/><\/a><figcaption id=\"caption-attachment-82150\" class=\"wp-caption-text\">Law 22\/1988, of July 28, 1988, on Coasts.<\/figcaption><\/figure>\n<p>This is also included in Article 74 of the <a href=\"https:\/\/www.boe.es\/buscar\/act.php?id=BOE-A-2014-10345\">Coastal Regulation<\/a> in <strong>Article 74 which establishes the general rules for the occupation of beaches: &#8220;<\/strong>A strip of at least six meters shall be left permanently free from the shore at high tide&#8221;.<\/p>\n<figure id=\"attachment_82152\" aria-describedby=\"caption-attachment-82152\" style=\"width: 1073px\" class=\"wp-caption alignnone\"><a href=\"https:\/\/lavozdeibiza.com\/actualidad\/2025\/01\/21\/nueva-irregularidad-del-concurso-bajo-sospecha-de-formentera-chiringuitos-instalados-en-zonas-inundables\/attachment\/reglamento\/\" rel=\"attachment wp-att-82151\"><img decoding=\"async\" class=\"size-full wp-image-82151\" title=\"regulation\" src=\"https:\/\/lavozdeibiza.com\/wp-content\/uploads\/2025\/01\/reglamento.jpg\" alt=\"regulation\" width=\"1073\" height=\"441\" srcset=\"https:\/\/lavozdeibiza.com\/wp-content\/uploads\/2025\/01\/reglamento.jpg 1073w, https:\/\/lavozdeibiza.com\/wp-content\/uploads\/2025\/01\/reglamento-300x123.jpg 300w, https:\/\/lavozdeibiza.com\/wp-content\/uploads\/2025\/01\/reglamento-768x316.jpg 768w\" sizes=\"(max-width: 1073px) 100vw, 1073px\" \/><\/a><figcaption id=\"caption-attachment-82152\" class=\"wp-caption-text\">The General Coastal Regulations.<\/figcaption><\/figure>\n<p>However, during last week&#8217;s sea floods, caused by the tide and the north wind, some beach bars ended up practically flooded. This is not a trivial matter from a business point of view. The closer the beach is to the sea, the more attractive it is to the client and, therefore, the greater the volume of business. The most striking case was that of <strong>Briss Formentera<\/strong> (Es Pujols), owned by the controversial entrepreneur <a href=\"https:\/\/lavozdeibiza.com\/tag\/angel-bustos?swcfpc=1\"><strong>Angel Bustos<\/strong><\/a>who had also been denounced for <a href=\"https:\/\/lavozdeibiza.com\/actualidad\/2024\/07\/25\/el-quiosco-de-es-pujols-de-angel-bustos-incumple-las-bases-del-concurso-bajo-sospecha-y-sirve-bebidas-en-toda-la-playa\/?swcfpc=1\">not complying with the rules of the contest and serving drinks all along the beach<\/a>, as <strong>La Voz de Ibiza<\/strong> reported. Last week this has been evidenced in images captured that illustrate this note, with sea water practically at the base of the beach kiosk. However, in the same irregularity -although less evident- are the beach bars <strong>Bartolo and Cala Sahona<\/strong>, at least.<\/p>\n<figure id=\"attachment_82146\" aria-describedby=\"caption-attachment-82146\" style=\"width: 1280px\" class=\"wp-caption alignnone\"><a href=\"https:\/\/lavozdeibiza.com\/actualidad\/2025\/01\/21\/nueva-irregularidad-del-concurso-bajo-sospecha-de-formentera-chiringuitos-instalados-en-zonas-inundables\/attachment\/chiringuito\/\" rel=\"attachment wp-att-82145\"><img decoding=\"async\" class=\"size-full wp-image-82145\" title=\"chiringuito\" src=\"https:\/\/lavozdeibiza.com\/wp-content\/uploads\/2025\/01\/chiringuito.jpg\" alt=\"chiringuito\" width=\"1280\" height=\"576\" srcset=\"https:\/\/lavozdeibiza.com\/wp-content\/uploads\/2025\/01\/chiringuito.jpg 1280w, https:\/\/lavozdeibiza.com\/wp-content\/uploads\/2025\/01\/chiringuito-300x135.jpg 300w, https:\/\/lavozdeibiza.com\/wp-content\/uploads\/2025\/01\/chiringuito-768x346.jpg 768w\" sizes=\"(max-width: 1280px) 100vw, 1280px\" \/><\/a><figcaption id=\"caption-attachment-82146\" class=\"wp-caption-text\">Formentera&#8217;s beach kiosks that do not comply with the 6 meter high tide restriction.<\/figcaption><\/figure>\n<h2>Stakeout documents<\/h2>\n<p>The location of the structures for the operation of beach kiosks was the responsibility of the technician <strong>Ana Mar\u00eda Fern\u00e1ndez Molero<\/strong>, who <a href=\"https:\/\/lavozdeibiza.com\/actualidad\/2024\/04\/19\/renuncia-la-tecnico-clave-del-concurso-de-los-servicios-de-playas-de-formentera\/\">ended up resigning in the face of criticism from expelled contestants<\/a>. She is now a Water Resources technician in the Govern. The civil servant was a fundamental piece in making the technical reports of the specifications of the contest of kiosks of Formentera. In addition to being responsible for scoring the bids, she made changes and assessments with the process already started and that were endorsed by the Contracting Committee at the time of making controversial awards. On the other hand, the facilities were carried out <a href=\"https:\/\/lavozdeibiza.com\/actualidad\/2024\/10\/02\/nueva-irregularidad-en-el-concurso-bajo-sospecha-de-formentera-los-chiringuitos-sin-la-autorizacion-obligatoria-de-costas-fruto-de-la-pasividad-del-consell\/?swcfpc=1\">without the mandatory minutes of staking out<\/a>, a technical document that certifies the correct location and construction of infrastructure in the <strong>Maritime-Terrestrial Public Domain (DPMT), <\/strong>which consists of an initial record at the beginning of the assembly and a final one, as an evaluation of the facilities. This is an essential technical document that guarantees that the installations comply with<strong>safety and legality regulations<\/strong>. One of them is the <strong>limitation of 6 meters from high tide.<\/strong> As advanced by <strong>La Voz de Ibiza<\/strong>, the Balearic Government confirmed that these beach establishments have been operating without this document since the beginning of the year.<strong><a href=\"https:\/\/lavozdeibiza.com\/actualidad\/2024\/10\/02\/nueva-irregularidad-en-el-concurso-bajo-sospecha-de-formentera-los-chiringuitos-sin-la-autorizacion-obligatoria-de-costas-fruto-de-la-pasividad-del-consell\/?swcfpc=1\"> have been operating without this document since the beginning of the season,<\/a><\/strong> which compromises the legality of the concessions and calls into question compliance with safety regulations.<\/p>\n<h2>Other noncompliance<\/h2>\n<p>In addition, according to the specifications, the beach bars must have  <strong>road access for water supply and sewage disposal.<\/strong><\/p>\n<p>However, several of them do not have such a condition and some of them were warned both orally and in writing, without any result.
