{"id":84622,"date":"2025-02-04T16:28:35","date_gmt":"2025-02-04T15:28:35","guid":{"rendered":"https:\/\/lavozdeibiza.com\/sin-categorizar\/2025\/02\/04\/the-jewel-in-the-crown-of-the-apb-bustos-appeals-against-marina-botafocs-concession-conditions\/"},"modified":"2025-02-04T16:28:35","modified_gmt":"2025-02-04T15:28:35","slug":"the-jewel-in-the-crown-of-the-apb-bustos-appeals-against-marina-botafocs-concession-conditions","status":"publish","type":"post","link":"https:\/\/lavozdeibiza.com\/en\/current-news\/the-jewel-in-the-crown-of-the-apb-bustos-appeals-against-marina-botafocs-concession-conditions\/","title":{"rendered":"The jewel in the crown of the APB: Bustos appeals against Marina Botafoc&#8217;s concession conditions"},"content":{"rendered":"<p>After learning the details of the<strong> basis of the tender<\/strong> to award the management and operation of the moorings, the fuel supply station, the dry dock and the commercial premises of the <strong><a href=\"https:\/\/lavozdeibiza.com\/actualidad\/2024\/11\/20\/la-joya-de-la-corona-de-la-apb-en-el-puerto-de-ibiza-nuevo-concurso-puente-para-marina-botafoch\/?swcfpc=1\">port of Botafoc<\/a><\/strong>The company <strong>Servicios Portuarios Botafoch<\/strong>, owned by businessman <strong>\u00c1ngel Bustos<\/strong>, has filed an appeal questioning the proposal of the Balearic Islands Port Authority (APB).<\/p>\n<ul>\n<li>\n<h5><a href=\"https:\/\/lavozdeibiza.com\/actualidad\/2024\/11\/20\/la-joya-de-la-corona-de-la-apb-en-el-puerto-de-ibiza-nuevo-concurso-puente-para-marina-botafoch\/?swcfpc=1\">APB&#8217;s crown jewel in the port of Ibiza: new bridge tender for Marina Botafoch<\/a><\/h5>\n<\/li>\n<\/ul>\n<p>This legal action has been filed by the lawyer <strong>Francisco Javier Jimenez de Cisneros<\/strong>, alleging that the contest rules establish <strong>restrictions that limit competition and benefit large operators<\/strong>, leaving other companies equally qualified to assume the concession at a disadvantage, as detailed by the site <em>Gaceta Nautica<\/em>.<\/p>\n<figure id=\"attachment_65634\" aria-describedby=\"caption-attachment-65634\" style=\"width: 750px\" class=\"wp-caption alignnone\"><a href=\"https:\/\/lavozdeibiza.com\/actualidad\/2024\/09\/19\/doce-millas-reclama-una-indemnizacion-millonaria-por-el-amano-a-favor-del-club-nautico-de-ibiza\/attachment\/resize_cisneros1\/\" rel=\"attachment wp-att-65633\"><img decoding=\"async\" class=\"size-full wp-image-65633\" title=\"resize cisneros1\" src=\"https:\/\/lavozdeibiza.com\/wp-content\/uploads\/2024\/09\/resize_cisneros1.jpg\" alt=\"resize cisneros1\" width=\"750\" height=\"450\" srcset=\"https:\/\/lavozdeibiza.com\/wp-content\/uploads\/2024\/09\/resize_cisneros1.jpg 750w, https:\/\/lavozdeibiza.com\/wp-content\/uploads\/2024\/09\/resize_cisneros1-300x180.jpg 300w\" sizes=\"(max-width: 750px) 100vw, 750px\" \/><\/a><figcaption id=\"caption-attachment-65634\" class=\"wp-caption-text\">\u00c1ngel Bustos and Francisco Javier Jim\u00e9nez de Cisneros Cid<\/figcaption><\/figure>\n<p>Among the questioned points of the tender are the prohibition to present in Temporary Joint Venture (UTE), the requirement of a minimum net worth of 5 million euros and the previous experience in the management of facilities with at least 350 moorings.<\/p>\n<p>These requirements, according to Botafoch Port Services, are<strong> arbitrary and disproportionate<\/strong> in comparison with other similar award processes.<\/p>\n<h2>Temporary Occupancy<\/h2>\n<p>The <strong>new concession<\/strong> to operate the Marina <strong>Botafoc<\/strong> marina will have a term of <strong>two years plus a third, extendable term<\/strong>, depending on the date of final approval of the Special Plan for the Port <strong>of<\/strong> Ibiza. <a href=\"http:\/\/lavozdeibiza.com\/tag\/plan-especial-del-puerto-de-ibiza?swcfpc=1\"><strong>Special Plan for the Port of Ibiza<\/strong><\/a>, <a href=\"https:\/\/lavozdeibiza.com\/actualidad\/2023\/12\/19\/triguero-hereda-el-diseno-del-puerto-de-rafa-ruiz\/?swcfpc=1\"><strong>instrument that is initially approved, pending the<\/strong><\/a>pending the resolution of the allegations <a href=\"https:\/\/lavozdeibiza.com\/actualidad\/2024\/04\/03\/pobre-respuesta-al-llamamiento-del-alcalde-triguero-a-la-participacion-sobre-el-plan-especial-del-puerto-de-ibiza\/?swcfpc=1\"><strong>allegations presented<\/strong><\/a> and of the definitive approval, for which <strong>there is no date<\/strong>.   <\/p>\n<p>This was approved by the <strong>Board of Directors of the Port Authority of the Balearic Islands<\/strong> at its meeting held last November.<\/p>\n<p>The term of operation of the new concessionaire will begin in <strong>March 2025<\/strong>. Therefore, there will be at least two more years of <strong>interim in a concession that requires important investments<\/strong>. In fact, the Special Plan contemplates a profound remodeling of the entire area.  <\/p>\n<p><a href=\"https:\/\/lavozdeibiza.com\/actualidad\/2024\/09\/25\/marina-botafoc-se-encamina-a-un-nuevo-concurso-transitorio-ante-el-retraso-en-la-aprobacion-del-plan-especial-del-puerto-de-ibiza\/?swcfpc=1\"><strong>La Voz de Ibiza<\/strong><strong> had already advanced that these were the intentions of Autoridad Portuaria de Baleares in relation to one of the crown jewels of the port of Ibiza.<\/strong><\/a> in relation to one of the <strong>crown jewels of the port of Ibiza<\/strong>. At least for its interests for its economic contribution to the coffers of the port authority. Not in vain, the APB earns a whopping 10 million euros per year fixed and 4% of the turnover of the concessionaire.  <\/p>\n<p>The APB has justified the new patch against a long-term concession, between 20 and 30 years, which allows to amortize the important investments that &#8220;this facility requires&#8221;, in the absence of the Special Plan.<\/p>\n<p>The purpose of this tender is to select the most advantageous solution for the granting of an administrative concession for the management and operation of a<strong> 97,000 square meter<\/strong> plot of land, of which 43,000 square meters correspond to land area, on which a series of buildings for commercial uses, a service station for the supply of fuel to pleasure boats and an area for dry docking and repair of boats are built.
