The prosecutor in the case of the deadly fire that occurred in ses Païsses (Ibiza) has ratified this Monday her request for permanent revisable prison for the woman accused of causing the fire in which one of the elderly she cared for died. «We have many indications and an implausible explanation, so we understand that the logical conclusion is guilt,» said the prosecutor, who defended that it was «crystal clear» that the woman set fire to a sofa and some cushions with the intent to kill, fully aware that one of the victims was totally dependent and could not escape.

The jury will remain incommunicado this Tuesday

Following the reading of the final reports of all parties, the jury will receive the object of the verdict on Tuesday, after which it will remain incommunicado until a decision is reached.

A jury trial for a deadly fire

The woman accused of causing the deadly fire that occurred in ses Païsses (Ibiza) in August 2023, in which an elderly man died totally dependent, denied Monday having set fire to the home of the victim, father of her then partner. Her statement marks the beginning of the final stretch of the jury trial, in which the prosecution requests for her the penalty of permanent revisable imprisonment for an alleged crime of murder and another of arson.

«I did not go to the victim’s house that early morning.»

The accused only responded to the questions of her lawyer, Cándido Valladolid, and strongly rejected all the accusations. She acknowledged that in the early morning of August 3, 2023, at 01.05 hours, she left her home, but insisted that she did not go to the house where the two elderly people she was taking care of were staying.

According to her, it was usual for her to go for walks at that time because she felt safer at night, after having suffered an attempted hit-and-run by her ex-partner. She also denied that she had had conflicts with the victim’s daughters, that she had asked for money from the family or that she called herself a «referent» and responsible for the family after her partner’s suicide attempt days before the fire.

A fire with one fatality

The Jury Court of the Provincial Court judges the woman for her alleged involvement in the fire that broke out in the family home in August 2023. Inside slept two elderly people under her care.

According to the prosecution, one of them was totally dependent and could not leave the house when the flames spread, which caused his death. The Public Prosecutor’s Office maintains that the fire was intentionally set and that the defendant is responsible for the incident, for which it requests the most severe penalty of the Penal Code.

The final phase of the trial

The trial against the woman accused of causing the deadly fire that occurred in August 2023 in a house in Ses Païsses, in Ibiza, enters its final phase on Monday with the statement of the accused, for whom the prosecution requests a permanent revisable prison sentence for the crimes of murder and arson.

The fire, which took the life of an elderly dependent, occurred when the defendant, the victim’s caregiver and partner of the deceased’s son, allegedly set fire to the home while both elderly men slept.

The defense denounces an accusation based on family suspicions

The oral hearing, held at the Provincial Court of the Balearic Islands, will resume this Monday at 09.30 am with the statement of the defendant.

Subsequently, the documentary evidence will be presented and the final reports of the parties will be presented. Tuesday will be reserved for delivery to the jury of the object of the verdict, at which time the jury will remain incommunicado until a decision is reached.

The trial has also revealed that the defendant has a criminal record, including a case in which she threw oil in the face of an ex-partner, causing her serious injuries, and another investigation for arson.

From the beginning of the investigation, the Civil Guard pointed to arson, concentrating the investigation on the current defendant due to her background and the evidence found at the scene of the incident.

Last Friday, the medical examiner who performed the autopsy told the jury that the elderly man died after a slow and painful agony caused by smoke inhalation, as he was unable to move on his own.

The jury trial being held at the Provincial Court of Palma for the deadly fire that occurred in ses Païsses (Ibiza) in August 2023 has revealed this Friday new details about the death of the 77-year-old man who lost his life in the incident, allegedly provoked by his son’s partner. The forensic doctor in charge of the autopsy has stated that the victim suffered a «slow agony» from smoke inhalation, unable to flee due to his physical dependence.

During his appearance, the doctor explained that the body of the deceased had second-degree burns only on the front and side of the body, indicating that the fire did not burn him completely. The determining cause of death was the massive inhalation of smoke inside the house, from which the elderly man could not escape due to his reduced mobility.

The coroner also prepared a psychiatric report this year on the accused, then partner of the victim’s son. In this document he concludes that, although she suffers from schizoaffective disorder, at the time of the events she did not suffer any outbreak or alteration that affected her ability to understand or decide, so she was «fully aware» of her actions. During the opening of the trial, the prosecutor had already advanced that the woman suffers from schizoaffective disorder, although she remarked that «she knew perfectly well what she was doing and had the will to do it», without showing nervousness or empathy at the time of the facts.

«It has no mortgages and no expenses.»

I.C.N.’s son assured the court that his mother was not experiencing financial difficulties, thus dismissing one of the possible motives put forward by the prosecution.

One of the key pieces of evidence against the accused are the recordings in which she is seen leaving her house at times coinciding with the fire. In these images the woman is wearing different clothes and her face is covered with a veil.

«She wore a veil so that the neighbors could not see her,» said the Guardia Civil investigators, insisting that the woman seen in fifty recordings is the accused «without any doubt».

In this context, the son reported that his mother went out for walks covered with scarves or hats since she suffered an attempted hit-and-run and death threats by an ex-partner, events that she reported to the Office of the Dona del Consell de Ibiza. Since then, she avoided going out at peak hours and modified her routines for fear of her aggressor.

«He always went out very early in the morning or at night to avoid running into him,» explained his son, who argued that this behavior was not an attempt to hide him.

The white bag and some Skechers sneakers

Despite the defense line, the prosecution maintains that I.C.N. is responsible for the arson resulting in death, for which revisable permanent imprisonment is requested.

The investigation is supported by recordings from 54 security cameras, which place it just 350 meters from the scene of the fire in the early morning hours of August 3.

One of the Civil Guard agents explained during his statement that, when searching the defendant’s home, they identified a white bag with a blue and pink logo, as well as Skechers sneakers. These elements coincide with those worn by the woman captured in the images that morning.
