Why is there still no housing in the Rent Safe program?
This system will allow the collection and exchange of data related to short-term rental services, with the aim of improving transparency, sustainability and access to housing. Among the most outstanding novelties of the new regulation is the creation of the Single Registry of Rentals, where it will be mandatory to register all housing intended for tourist and temporary rentals. The main objective of this system is to guarantee the traceability of rentals, facilitating their supervision by the administrations and combating irregular practices. The Digital One-Stop Shop for Rentals will centralize all related procedures, such as obtaining the mandatory identification number for each property. In addition, digital platforms will be obliged to share data periodically with this window, reinforcing regulatory control and promoting greater transparency in the sector. The Royal Decree came into force on January 2, 2025, but the provisions will start to apply from July 1, 2025, granting owners, platforms and administrations a period of technological and functional adaptation. During this time, all players are expected to implement the necessary tools to comply with the regulations.
Temporary housing and housing for tourist use
The Spanish legal system differentiates between two types of short-term rentals: temporary use housing is not of a permanent residential nature and is intended for specific housing solutions such as students, temporary jobs, or stays during medical treatment. In these cases, no additional information will be required from the Autonomous Communities or municipalities to obtain the mandatory registration numbers, since these are rentals regulated by Law 29/1994, of November 24, 1994, on Urban Leases. On the other hand, those dwellings intended for tourist rentals -among them, for example, Airbnb- will be subject to specific regulation by the autonomous communities or city councils. Owners must apply for the necessary marketing procedures before the autonomous communities or city councils, which are the competent bodies to regulate and supervise this market.
How to obtain your registration number for your seasonal housing rental?
To apply for the registration number the owner must prepare the following documentation:
- Cadastral reference and the exact address of the property.
- It will be detailed, if you want to rent the whole house or by rooms.
- Number of people who will be able to use the dwelling.
The procedure for requesting a registration number is available through the electronic office of the Association of Registrars. It is necessary to identify yourself with the electronic certificate and complete the application with the information already prepared. The association of registrars will immediately issue a registration number on a temporary basis. After checking the documentation submitted, and if everything is correct, the college of registrars will change the status of the registration number as definitive. The online platforms dedicated to the rental of seasonal housing will request the Registration Number obtained in the previous step. In this way, the property will be published and will comply with all the requirements demanded by both the European Community and the Spanish Government.
How to obtain your registration number for your vacation rental?
To apply for the registration number the owner must prepare the following documentation only:
- Cadastral reference and the exact address of the property.
- It will be detailed, if you want to rent the whole house or by rooms.
- Number of people who will be able to use the dwelling.
- Complies with the requirements established in the Autonomous Community where the home is located.
As it is a property for tourist rental, the owner will go to carry out the necessary procedures required by the autonomous communities to be able to offer the property for tourist rental.
