After learning the details of the basis of the tender to award the management and operation of the moorings, the fuel supply station, the dry dock and the commercial premises of the port of BotafocThe company Servicios Portuarios Botafoch, owned by businessman Ángel Bustos, has filed an appeal questioning the proposal of the Balearic Islands Port Authority (APB).
This legal action has been filed by the lawyer Francisco Javier Jimenez de Cisneros, alleging that the contest rules establish restrictions that limit competition and benefit large operators, leaving other companies equally qualified to assume the concession at a disadvantage, as detailed by the site Gaceta Nautica.
Among the questioned points of the tender are the prohibition to present in Temporary Joint Venture (UTE), the requirement of a minimum net worth of 5 million euros and the previous experience in the management of facilities with at least 350 moorings.
These requirements, according to Botafoch Port Services, are arbitrary and disproportionate in comparison with other similar award processes.
