The role of the councilor Javier Serra, the fact of his shareholding in Marina de Formentera and the link of this company with Indeisla, the firm that is the sole shareholder and administrator of two of the best rated -Apartamentos Castaví and Paraíso de Los Pinos- have also been put as one of the central elements by the four contestants in the complaint they filed with the Guardia Civil of Formentera. to request an investigation into whether there are crimes of prevarication and influence peddling in everything that is happening in the mega-contest of beach services. Javier Serra is second vice president of the Consell, member of the Governing Board, president of Compromís amb Formentera, a coalition party with the PP in Sa Unió. Thus, not only exposed the link between Daisee Aguilera Fletcher, former Minister of Environment in Gent per Formentera and Ana Fernandez Molero, the key technician author of the technical reports that assessed the bids in breach of the changes she herself had introduced with the open escrows. They also provided more indications that generate suspicions. In that sense, they state that “Indeisla SA has corporate relations with Marina de Formentera SA, in which the member of the government team, the councilor Javier Serra, and president of the political party Compromís, has a stake according to published information,” alluding to the register of assets held by La Voz de Ibiza and where Serra claims to be the holder of 22.40% of the same, with a market value of 437,448 euros .
Bidding on more lots than the number of lots for which they were awarded
Precisely, the two highest scoring companies that are part of the business conglomerate of Angel Bustos are in the crosshairs of the former kiosk owners not only for having been two of the six companies awarded with the changes in criteria and for their indirect link with Serra: they warn of possible collusive causes. For the complainants, another indication that affects certain lots of the contest (19 and 24, in this case) is that the two lots proposed to award by the Bureau are companies with the same shareholders and whose administrator is another company owned by the same shareholders, Apartamentos Castaví and Paraíso de los Pinos whose administrator is the same: the company Indeisla S.A. Therefore, what is reflected in the administrative specifications has not been fulfilled here, which allowed to submit a single offer to the lots of type A of beach kiosks. In fact, these are independent companies, so it cannot be said that the same company is on the verge of winning two lots at the extraordinary meeting of the Governing Board scheduled for today. A separate question is whether being part of the same group as is the case is affected by the limitation included in the tender documents.
Special remedies
Among the accusations that make up the request for investigation, they have provided that “in Lot 24 the company Paraíso de los pinos S.A. (the company whose project was carried out by Daisee Aguilera) was allowed to correct the NIF and the DNI of the company’s representative in an extemporaneous manner, documents that were not presented in 2022 and therefore cannot be corrected in 2024.
Cause of abstention in the contest
The companies that have appeared before the Civil Guard warn that this situation “in addition to being a cause for abstention from intervening in the contracting file, may have influenced the other members of the government team“. The focus placed on the government team of Llorenç Córdoba becomes important since, for the former bidders, “it intends to award the contract against the legal reports issued and without a resolution on the complaint of irregularities brought to light by us as bidders, in addition to the one that other bidders have presented and has appeared published in the press”. Finally, they insist that despite the fact that the nullity of the procedure has been requested and legally grounded, certain authorities insist on awarding the contract without a legal report that resolves the reported irregularities.
