A man faces from Tuesday a trial at the Provincial Court of Palma, accused of having raped a pregnant woman with intellectual disabilities in Ibiza in July 2021.
The victim had expressly stated her refusal to have sex with him, but he sexually assaulted her in an abandoned house on the island.
The prosecution is demanding a 25-year prison sentence, as well as ten years of supervised release after serving the sentence, and a two-decade restraining order against the victim.
He lured her by trickery and took her to an uninhabited place
According to the account of the Public Prosecutor’s Office, the events began when the defendant summoned the victim to a bar, with the excuse of showing her something. Under that pretext, he drove her to an abandoned house, a place with no other people present, where he allegedly committed the aggression.
During the first moments, the man began kissing and caressing the woman, who, according to the indictment, had an intellectual disability that affected her ability to make decisions.
The victim clearly refused to have sex, but the defendant forced her anyway.
While perpetrating the rape, the man uttered insults and disqualifications against the woman, according to the indictment. The situation of special vulnerability of the victim, together with the previous sentimental relationship between the two, aggravates the facts that are now being judged.
