The First Section of the Provincial Court of Palma judges this Friday a man accused of receiving at his home in Ibiza a package with MDMA and ketamine valued at more than 45,000 euros, according to the prosecution’s indictment. The trial is held from 09.30 am and the Prosecutor’s Office demands eight years in prison and a fine of 120,000 euros for an alleged crime against public health.
The facts date back to June 26, when, according to the prosecution, the defendant had agreed with unidentified third parties to receive a package containing narcotics at his home. The investigation detected the shipment before its delivery, which allowed the authorities to activate a surveillance device, according to the usual protocols in operations against drug trafficking on the island.
Drug substitution and controlled delivery
The Instruction Court number 3 of Ibiza, which was in charge of the proceedings, authorized the substitution of the substances for innocuous material and their controlled delivery, a common practice to secure evidence without putting the drug into circulation. Although the package was picked up by a woman, the accused assumed before the examining magistrate to be the sole responsible and addressee of the shipment, an extreme that the Prosecutor’s Office sustains in its brief.
Sentencing and trial proceedings
The public prosecution maintains the request for eight years’ imprisonment and a fine of 120,000 euros, considering the defendant’s participation in the receipt of MDMA and ketamine for illicit purposes to be proven. The court will evaluate the evidence during the hearing, including the police actions and the defendant’s statement, before sentencing the defendant.
