The High Court of Justice of the Balearic Islands (TSJIB) has confirmed the sentences imposed on a father and his son, both Italian nationals, for a crime against public health related to the cultivation of cannabis for sale and possession of ketamine in Ibiza. The resolution ratifies in full the sentence handed down in the first instance by a provincial court.
The father has been sentenced to three years and six months in prison and a fine of 46,000 euros, while the son must serve two years in prison and pay a fine of 45,000 euros, according to the sentence confirmed by the Balearic high court.
Large cultivation facility
During the search of the home of the accused, the agents located a complete installation for the cultivation of cannabis for sale and distribution, with spotlights, air renewal systems, ventilation fans and specific fertilizers. In the property were also seized 890 euros in cash and 32.33 grams of ketamine, with an estimated value of 832 euros in the illicit market.
Both defendants acknowledged the facts related to marijuana, although the father denied his involvement in the possession of ketamine, claiming that the substance was intended for the son’s self-consumption. However, the court emphasizes that the lack of acknowledgment does not preclude proving drug trafficking by other evidentiary means.
The Court ruled out that the son suffered from a serious addiction that could explain the possession of ketamine, and concluded that the quantity seized was only justified by the intent to obtain an illicit benefit, which reinforces the existence of drug trafficking.
The sentence is not final and can be appealed in cassation before the Supreme Court, according to the High Court of Justice of the Balearic Islands.
