The Local Government Board of the Ibiza Town Hall has approved this Monday the imposition of two urban planning sanctions derived from the illegal tourist use of dwellings, for a joint amount of 740,239.51 euros, as reported by the Consistory.
The penalties correspond to the value of the affected buildings-453,416.77 euros in one case and 286,822.74 euros in the other-on which the sanctioning criteria provided for in the current regulations have been applied, having been accredited a change of use from residential to tourist without the necessary enabling title, an infringement classified as serious in Law 12/2017, of December 29, of Urban Planning of the Balearic Islands.
Unauthorized housing for tourists
During one of the inspections carried out in 2024 by the Local Police, the agents found that one of the sanctioned dwellings was being used for tourist accommodation without a license, in contravention of urban planning regulations. In application of article 167.4 of Law 12/2017 – which establishes fines of between 50% and 100% of the value of the building when the change of use is not permitted – the corresponding sanction was imposed.
The second file concerns another dwelling where an unauthorized tourist use was also verified. In this case, the sanction has been issued in accordance with Articles 163 and 167 of Law 12/2017 and the Regulation of the sanctioning procedure approved by Decree 1/2024, which regulates the criteria for graduation and responsibility in urban planning matters.
The City Council keeps up the pressure against intrusiveness
The mayor of Eivissa, Rafael Triguero, has defended the importance of acting firmly against this type of non-compliance. “Flats without a tourist license cannot be rented to those who come to Eivissa on vacation, because they represent unfair competition for the hotel sector or legal tourist housing. We will continue with the pressure against those who break the rules,” he said.
The City Council recalls that unauthorized tourist use is one of the main challenges in urban and residential matters in the city, where inspection work continues to be reinforced to detect and sanction irregularities.
