The plan of seasonal cab licenses 2025-2028 of the Sant Josep de sa Talaia Town Hall is under judicial scrutiny. According to municipal resolutions of summons to interested parties to which La Voz de Ibiza has had access, the Consistory is facing several contentious-administrative proceedings currently in process. According to what has been confided to this media from the salaried sector of the municipality, at least one of these appeals has already been resolved by a court, with a ruling that requires the City Council to grant a temporary license that had been initially denied.
The documentation consulted by this media corresponds to Mayor’s decrees issued after court summons, in which both the City Council and the possible affected parties are summoned to appear in the proceedings opened in the contentious-administrative courts of Palma. These summons certify that the lawsuits have been admitted for processing and are currently in progress.
Among employees of Sant Josep are aware of at least six legal appeals against the City Council. This media has asked the Consistory to confirm the number of legal proceedings it faces for its seasonal plan, but the Consistory has not yet responded.
Appeals against the terms and conditions and against the award
Although the City Council has not provided detailed information on the content of the claims despite the consultation made by this medium, from the sector of salaried cab drivers of Sant Josep it is argued that the resources are divided into two blocks. According to this version, two procedures question the regulatory bases of the seasonal plan, while four others are directed against the specific allocation of licenses.
In relation to the challenges to the bases, industry sources point to discrepancies with the design of the scale, the way merits are accredited and computed and the configuration of the distribution of licenses by categories, issues that, in their opinion, could not be fully in line with the law or generate legal uncertainty among applicants.
The focus on merit computation
The appeals focused on the awarding of the contract emphasize, according to the sector consulted, possible errors in the calculation of scores, the unequal application of the criteria or the evaluation of the documentation submitted during the correction phase. This line of criticism finds partial support in the first known court decision, which has forced the City Council to rectify an award after appreciating a calculation error.
In this specific case, the affected party had previously filed an appeal for reconsideration before the Consistory itself, requesting a review of his score. After the administrative rejection, he went to court, where the judge ruled in favor of the appellant and ordered the granting of the temporary license.
An administrative process with corrections and lottery
The Taxi Seasonal Plan 2025-2028 was approved in February and processed during the following weeks by means of provisional lists, a period of allegations and the final approval of the successful bidders in April. In this process, the City Council itself introduced corrections in the calculation of seniority and merits, after detecting material errors in some applications.
In addition, the Consistory had to resort to a public lottery to resolve ties between applicants with identical scores, a procedure that made it possible to award the last available licenses and to establish a reserve order for possible resignations or vacancies. According to industry figures, about 150 wage earners applied for seasonal licenses. The City Council granted 64.
Expectation in the sector and municipal silence
The group of salaried employees is closely monitoring the evolution of the pending proceedings, in view of the possibility that the criterion established in the first ruling may be taken into account in other appeals if the courts detect similar errors. However, any general effect will depend on the rulings handed down on a case-by-case basis.
The Sant Josep Town Hall has so far not responded to La Voz de Ibiza’s request for information on the exact number of open legal proceedings, their status or the possible consequences of the already known ruling for the whole seasonal licensing scheme.
