72 non-compliances – ranging from minor to very serious – have been detected by Formentera’s beach bars in the contest under suspicion during the past season, as acknowledged by the Consell Insular this morning.
In this regard, they have detailed that, through the Conselleria de Medio Ambiente, has agreed to the initiation of “several sanctioning procedures due to the detection of repeated breaches in different beach concessions, as a result of the technical inspections carried out during the season”.
In total, 72 sanctions were imposed, corresponding to 30 minor infringements, 37 serious infringements and 5 very serious infringements, with an overall economic amount of 55,041 euros.
“The analysis of the files shows a pattern of recurring non-compliance that affects key aspects of the operation of the concessions,” the Consell explains.
Among the most common infractions are the lack of mandatory cleaning and maintenance records, failure to comply with the complementary offer committed to in the bidding documents, as well as deficiencies in environmental matters, especially with regard to waste separation, the use of unauthorized materials and the protection of the dune system.
In addition, non-compliance with regulated prices has been detected repeatedly, especially in the sale of water, in violation of the conditions established in the technical specifications. Deficiencies in safety, hygiene, user information and general maintenance of the facilities have also been sanctioned.
“The concessions that accumulate more sanctions add up to 15 breaches, in one of the cases, totaling a total of 11,305 euros , and two of them accumulate up to 11 irregularities totaling between 11,200 euros and 6,800 eros. On the other hand, one of the concessions accumulates three irregularities amounting to 2,300 euros”, explained this morning from the Consell without identifying the concessionaires.
The obligation to disassemble
A little less than a week before the deadline for the dismantling of the beach kiosks, from the Consell have reported that, in parallel to the economic sanctions, “has formally notified the awardees the obligation to have dismantled the facilities from January 15, in accordance with the conditions set out in the concessions, as already notified last season”.

In addition, they have clarified that this requirement “is independent of the sanctioning proceedings and responds to the need to ensure strict compliance with current regulations”.
The councilor of the area and first vice-president, Verónica Castelló, has pointed out that “compliance with the specifications is not optional and repeated infringements have consequences”, despite the fact that last year she tried to evade this obligation established both by the concession title and the Coastal Regulations.
Castelló, for her part, trusts that the different concessions will comply with the order to dismantle the installations as of January 15 and for one month”.
