The top officials of the previous leadership of Gent per Formentera in the Consell de Formentera, Jaume Ferrer Ribas, Sonia Cardona Ferrer, Silvia Margarita Tur Ribas and Isidor Torres Mayans, must sit in the dock in April next year before the Provincial Court Section No. 1.will have to sit in the dock in April of next year before the Provincial Court Section No. 1 in Palma de Mallorca for the rigging in the appointment of firefighters collaborators of the Consell Insular, with the aim of benefiting the son of the current councilor José Marí Mayans, of the same political group.
As La Voz de Ibiza advanced, the accusations, which range from crimes of prevarication to false documentation, are based on the flagrant and deliberate breaches of the requirements to fill five positions in the Fire and Rescue Service, in addition to paralyzing for a year the file so that the firefighter benefited could access the position, with the risk that this implied due to the lack of personnel. On September 22, 2022, after five and a half years of investigation, Judge Carmen Martín Romero, of the Instruction Court Nº 3 of Ibiza, issued the order for the opening of the oral trial against the accused, an act that had not been disclosed until now.
In addition, the counsel for the Administration of Justice, established the oral trial sessions for April 28, 29 and 30, 2025, at 9:30 am. La Voz de Ibiza has had access to the court documents of the order opening the oral trial, in addition to the conclusions of the public prosecutor and the civil judgment of the plaintiff that derived justly in a criminal investigation.
A tailor-made suit
It all began on September 3, 2011, when the bases for the selection “of firefighters collaborating with the Consell de Formentera” were published in the Official Gazette of the Balearic Islands No. 131.. There it was detailed the “internal regulations of the Fire and Rescue Service of the Consell by which the requirements were regulated to cover the five positions of collaborating firefighter budgeted by the corporation itself”. One of the indispensable requirements was to have driving license C “or to obtain it in a maximum term of four months, in the same way that the taking possession and/or formal acceptance of the position was demanded once the call was made for the case of approval of the selective process”. Failure to comply with this meant the expulsion of the applicant and the call for the next one selected from the list. On November 2, 2012 a decree was issued by the presidency of the Environment area of the Consell Insular de Formentera approving the provisional qualifications of the seven participants in the process. All despite the fact that
there were three unsuccessful applicants to apply for the position: “Marí was only 19 years old at the time of the facts (he was born in January 1993) and was therefore ineligible to obtain a driving license C, which requires the age of 21 years; on the other hand, FootwearThe Committee notes that at the time of accepting the position (January 8, 2013) he did not have a driver’s license, nor did he obtain it within the four-month period required by the regulations; and finally, EspinosaIn October 2012, he expressly renounced to the appointment that would be made four months later (January 2013)”. The prosecutor of the case was able to establish that “the defendants, by mutual agreement, with absolute disregard for the established bases and completely ignoring the regulations that governed the selective process, having full control and domination of the fact, decided to make the appointment of Carlos Marí Mayans, Carlos Calzado Fernández and Antonio Espinosa, to favor them in obtaining the job to the detriment of other participants”.
File paralyzed for one year
In addition to the irregularities described above, the defendants used another trick: to freeze the file for one year until Marí Mayans was old enough to have his driver’s license.
This undue and unjustified delay in the procedure was highlighted in the sentence by the Contentious Administrative Court No. 2 of Palma, which determined to recognize the complainant Rubén Castellar Lozalo -perjudicated by this rigging- the status of “collaborating firefighter since January 2013 (date on which he should have been effectively called as a worker)” and compensate him with 80,199 euros.
Antonio Espinosa’s resignation was the perfect excuse to paralyze the file for more than a year, enough time for Marí Mayans to reach the age of 21 to obtain the C permit and be able to appoint him, which occurred on May 15, 2014. The prosecutor concludes that, “in the exercise of their functions and positions by common agreement they arbitrarily decided to benefit certain people in a selection procedure of collaborating firefighters of the Consell de Formentera. To this end , they issued as many resolutions as necessary, carried out the steps and omitted the acts to which they were obliged, in violation of the applicable regulations and without any justification whatsoever“. In spite of the civil sentence and the criminal investigation, Marí Mayans continues to hold the position of fireman of Formentera. He is the son of José Marí Mayans, current member of the Code of Ethics and Good Governance Commission, who signed the biased report against the president of the Consell Insular, Llorenç Córdoba, which has resulted in the motion of censure promoted by GxF and PSOE, which has been and that has had the endorsement of Sa Unió, which gave in to the demands of the left-wing groups.
