Cayetano Rivera ‘s accident continues to generate headlines. The bullfighter, 48 years old, suffered last Sunday a mishap with his vehicle in
Rivera, who crashed his van into a palm tree, got out of the vehicle under his own power and was not seriously injured. The incident took place around eight o’clock in the evening, when Cayetano was returning home after a quiet day.
The accident, according to the lawyer’s account
Moeckel has offered his version of what happened in statements to LOC: “According to Cayetano, he was returning home shortly after eight o’clock in the evening. It’s not seven o’clock in the morning or anything like that, be very careful with that, the hours are very important”.
The bullfighter was driving along the road leading to his urbanization when, according to his defense, he was distracted looking for the automatic control to open the garage fence. “At that moment, Cayetano started to look in the car for the automatic control to open the fence, and he got distracted. And when he realizes it, he is already on top of it and gets right into the traffic circle,” the lawyer explains.

The vehicle ended up crashing into a palm tree in the center of the traffic circle. Despite the impact, Cayetano got out of the car without help and remained for a few minutes next to the vehicle, with a jacket hanging from his arm, as shown in the images posted on social networks.
“There was no escape”: the version of his departure from the site
The Sevillian lawyer insists that his client did not try to flee the scene. “Obviously, that is not done by anyone who is going to flee,” he points out. “He told them that, since he lives next door, and since thank God there was no personal injury to anyone, he was going to go home, and that if the police or anyone came, to tell them where he was. A person who wants to flee, doesn’t go to his house 25 meters away,” Moeckel adds.
It was the neighbors and witnesses themselves who alerted the authorities, following the usual protocol in any traffic accident.
The controversy of the breathalyzer test
One of the most commented points after the accident has been whether Cayetano Rivera refused to take the breathalyzer test. Some sources indicated that the diestro refused to take the test, which has been denied by his lawyer.
“The only discussion here is that the police are going to defend, I imagine, that he asked for the test, and we defend that, in the case that this was the case, Cayetano was in a dazed situation, he could not understand what they were telling him,” Moeckel clarified.
The lawyer maintains that, if there was any confusion, it was due to his client’s state of shock after the impact. “What the police say is not that it is true or false. They will say what they say, but my client was in a dazed state that it was impossible for him to find out. He consciously did not refuse to take the breathalyzer test,” he adds.
“It could have been an oversight or a failure of reflexes.”
Regarding Cayetano’s initial statements, who, when he got out of the vehicle, commented that “his brakes had failed”, Moeckel considers that it was a spontaneous and confused reaction after the accident. “That’s not where I come in. I think it should be a lack of attention more than anything else, and already at that point, absent-minded, I wouldn’t know which pedal I was hitting. An absent-mindedness. But yes, the brakes could have failed, or it could also be that what failed was the reflex of stepping on the brake. And there is no more story,” explains the lawyer.
The lawyer considers that the media hype is mainly due to the fame of the bullfighter: “His name is Cayetano Rivera; if his name were Joaquín Martín, nobody would have talked about this”.
“There is no reason for lawsuits.”
Asked if the bullfighter will take any legal action, Moeckel is categorical: “What lawsuit am I going to file? Against the palm tree because it was there? What Cayetano has to do is to be more attentive to the cars and not to look at the controls or the cell phones”.
The lawyer confirms that now a phase of judicial instruction is opened in which the facts will be investigated and it will be determined if there was any infraction or crime. “There will be an investigation and we will see what is there. This has only just begun. Now the proceedings are starting to verify the facts of the accident, the investigation to find out what happened and how the events unfolded. This has little history. And I imagine it will come to nothing,” says Moeckel.
“The police investigate, but the judges are the ones who pass sentence.”
In statements to Sonsoles Ónega’ s program on Antena 3, Moeckel wanted to emphasize that police work does not imply automatic guilt: “Fortunately, the police investigate, but they are not the ones who pass sentence. That is what magistrates and judges are for. One thing is that the police can understand that there has been disobedience and another that in the end it is true that there has been disobedience or not. The police carry out their investigations and the judges will decide,” he explained.
The lawyer insisted that Cayetano will cooperate with the authorities at all times and that he has full confidence in the judicial process.
